Special Counsel Jack Smith has formally asked a judge to dismiss all charges against President-elect Donald Trump related to the investigation into the January 6th U.S. Capitol breach.

The request, filed on Monday afternoon, now awaits approval from Judge Tanya Chutkan, who will make the final decision on whether the case will be dropped.

This filing comes shortly after Trump’s victory in the 2024 presidential election, signaling that Smith is preparing to wind down the case against the former president.

Earlier this month, Smith had already moved to vacate all deadlines in the election interference case against Trump, which is being handled in Washington, D.C.

Although this move was expected, it did not include a full dismissal of the charges, and Smith indicated that an updated report on the status of the case would be issued by December 2.

Trump has consistently pleaded not guilty to all charges stemming from both the January 6th investigation and the 2020 election interference case.

He has also taken the fight to the U.S. Supreme Court, arguing that he should be immune from prosecution for actions taken as part of his official duties as president.

The high court ruled in Trump’s favor, stating that he was immune from prosecution for official presidential acts. As a result, Smith had to file a new indictment.

Trump again pleaded not guilty to these new charges.

In addition to the legal battles surrounding the January 6th charges, Trump’s legal team has also sought to have the election interference charges dropped, arguing that Smith’s appointment as special counsel was unlawful.

The legal challenges against Smith’s appointment continue, with ongoing efforts to dismiss the case.

Earlier this summer, Smith’s case involving Trump’s alleged improper retention of classified records was dismissed by a federal judge, who ruled that Smith had been unlawfully appointed as special counsel.

While the ruling in that case is being appealed, it remains uncertain whether Smith will continue to pursue the matter.

Following the filing by Smith, Trump’s spokesman, and incoming White House communications director, Steven Cheung, issued a statement celebrating the decision. “The American People re-elected President Trump with an overwhelming mandate to Make America Great Again. Today’s decision by the DOJ ends the unconstitutional federal cases against President Trump, and is a major victory for the rule of law,” Cheung said. “The American People and President Trump want an immediate end to the political weaponization of our justice system, and we look forward to uniting our country.”

Trump’s legal team has maintained that the investigations against him have been politically motivated and unlawful.

The dismissal of these charges would represent a significant legal victory for the former president as he prepares to return to office in January.

Special Counsel Jack Smith is expected to step down from his role before Trump is sworn in as president, signaling the end of his involvement in the ongoing investigations.

The decision to drop the charges would mark a dramatic shift in the direction of the legal cases surrounding Trump, potentially bringing an end to one of the most contentious and politically charged investigations in recent U.S. history.
