Former federal prosecutor Andy McCarthy explained Wednesday that contrary to claims by Democrats and “well-heeled left-wing groups,” the Department of Government Efficiency (DOGE) is “legitimate.”

President Donald Trump established DOGE in a Jan. 20 executive order that repurposed the United States Digital Service and added additional responsibilities to the commission involving the hiring of new federal employees with a Tuesday order. McCarthy reacted to legal attacks on DOGE from Democrats and government unions arguing the during an appearance on “Fox and Friends.” (RELATED: You Won’t Believe How Many Times Corporate Media Outlets Regurgitated Newest Liberal Talking Point About Trump, Musk)

“The litigation is kind of designed to slow things down and they have vast resources to conduct this kind of litigation. You have sort of these cabals of state attorneys general, you have all kinds of well-heeled left-wing groups that can do this. But ultimately, I think, if you get clear rulings from the court, a lot of this stuff will fade away,” McCarthy told guest host Emily Compagno. “It seems to me the weakest position that they have is that executive branch officials, and whether they like it or not, they keep calling it the so-called DOGE, as if it didn’t exist, it actually is a component of the executive office of the president in the White House, it’s a refinement of something that was begun under Obama.”

“So, this is a legitimate government entity, and they answer to the president, who runs the executive branch,” McCarthy continued. “So the idea that an executive official answerable to the president, can’t look at what’s going on in executive agencies is pretty nutty and I think that should fade away fast.”

A Feb. 4 memo from the Office of Personnel Management (OPM) stated that Chief Information Officers at government agencies should be re-classified as political appointees and would work with DOGE.

A federal judge extended the deadline for a buyout offer sent to over two million federal government employees Monday in a case brought by the American Federation of Government Employees, a union representing federal workers. United States District Judge John J. McConnell Jr. of the District of Rhode Island, a contributor to Democratic causes before being named to the federal bench during the Obama administration, threatened Trump and administration officials with criminal contempt charges over the spending freeze Trump ordered.

McCarthy hinted that a resolution on the cases, in which Democrats have claimed DOGE’s efforts to cut agencies encroaches upon congressional prerogatives and that the agency is wrongfully accessing taxpayer data, might take a while.

“I think what we are seeing is a lot of forum shopping and there is a lot of opportunity for these lower court judges to slow walk-stuff,” McCarthy said. “And then the thing you have to worry about up in the Supreme Court is that you have some judges who just don’t like the emergency docket and they like the idea, even if there are justices who you think would be inclined to rule the president’s way, they like things to come in regular order, rather than expedited.”

Democrats joined protests outside the headquarters of the United States Agency for International Development (USAID) and the Treasury Department Feb. 4 after Tesla CEO Elon Musk announced plans to close down the former agency in his capacity as chairman of DOGE.
