MSNBC legal analyst Danny Cevallos pushed back against media narratives suggesting that President Donald Trump is facing devastating legal defeats over his executive orders.
During a recent panel discussion, Cevallos argued that headlines framing the legal battles as major losses for Trump are misleading and could set up his critics for disappointment when rulings eventually go in Trump’s favor.
“Over the weekend, I read all these headlines and the headlines were like, Trump suffers legal blows,” Cevallos said. “Another one was, Trump hit with unexpected loss.”

However, he cautioned that the portrayal of these court decisions as significant setbacks misrepresents what is actually happening in the legal process.
Many of the rulings being described as defeats, he explained, are procedural pauses rather than substantive decisions.
“These are not major setbacks,” Cevallos said, emphasizing that most of these rulings are at the “stay stage,” meaning courts are merely delaying enforcement rather than ruling on the legality of the orders themselves.
“Nobody’s winning or losing on the merits,” he added. “They’re hitting the pause button until they can decide the case on the merits.”

He compared these early rulings to exhibition soccer matches, saying they don’t carry real weight until the cases make their way to the Supreme Court.
This, he argued, is why they should not be seen as genuine legal blows to Trump.
Cevallos also pointed out a strategic advantage that Trump has when it comes to executive orders—his ability to quickly reissue them.
“Do you know what it costs to do an executive order? A piece of paper and a Sharpie. That’s it,” he said.
If a court rejects an order for vague language, he explained, the administration can simply modify and reissue it.
Unlike legislation, which requires congressional approval, executive orders can be adjusted and reinstated almost immediately.
One example Cevallos discussed was a recent ruling by the Ninth Circuit Court concerning birthright citizenship, in which the court denied an emergency stay requested by Trump’s legal team. Despite the decision, Cevallos downplayed its significance.
“But they were never going to win that,” he said, noting that the real takeaway is Trump’s legal team’s willingness to appeal every decision.
“They’re going to fight at every single turn. And that means appealing absolutely everything with the knowledge that they’re going to lose some of them because it costs them nothing.”
Summarizing his perspective, Cevallos rejected the idea that Trump is on the losing end of a legal battle he cannot recover from.
“I do not see this as Trump losing over and over and over again,” he said, arguing that the more accurate picture is Trump’s aggressive legal strategy.
“They’re not going to stop and they’re going to keep fighting it every time, and they are going to win some of these.”

As Cevallos laid out his analysis, the reaction from his co-panelists was telling. Several sat in silence, appearing visibly uncomfortable with his take.
At one point, their expressions almost suggested disappointment, as if they had been expecting a different narrative.
One panelist even looked close to tears, underscoring just how deeply some in the media have invested in the idea of Trump’s legal downfall.
