Despite serious criminal charges, including child rape and drug trafficking, multiple illegal aliens have been released from Massachusetts jails in recent months, in some cases without bail, due to the state’s restrictions on law enforcement cooperation with U.S. Immigration and Customs Enforcement (ICE).

The releases come amid a renewed crackdown by federal immigration authorities under President Donald Trump’s directive, with his border czar, Tom Homan, sharply criticizing Massachusetts Governor Maura Healey and Boston Mayor Michelle Wu for their refusal to assist ICE with deportation operations.

Both Healey and Wu, Democrats, have defended their immigration policies. Wu recently reaffirmed her stance at a public event, saying, “We stand with immigrants,” and “No one tells Boston how to take care of our own, not kings, and not presidents who think they are kings.”

Although Healey has stated that Massachusetts is not a sanctuary state, a 2017 ruling by the Massachusetts Supreme Judicial Court in Lunn v. Commonwealth prevents state and local law enforcement from honoring ICE detainers.

As a result, criminal illegal aliens must be released unless other legal grounds for detention exist.

According to CBS News, at least seven illegal aliens facing serious charges have been released recently in Massachusetts.

One case involved 39-year-old Honduran national Juan Alberto Rodezno-Marin, who was charged with masked armed robbery, indecent assault and battery, assault to rape, and assault with a dangerous weapon.

Despite these charges and a filed ICE detainer, the Middlesex Superior Court released him on his own recognizance in December.

Rodezno-Marin had previously been deported twice for illegal reentry into the U.S. in 2008 and 2009.

He remained free for nearly a month before ICE took him into custody.

ABC News also reported that two illegal aliens charged with child rape were released from the Worcester County Jail on $500 bail each.

In another case, 49-year-old Guatemalan national Jose Fernando-Perez, charged with six counts, including forcible rape of a child and aggravated rape of a child, was released in 2022 on $7,500 bail with a condition to remain at home.

ICE arrested him on February 2, 2025.

At the time, ICE’s acting field office director in Boston, Patricia Hyde, said Fernando-Perez’s “horrific crimes against a minor in our commonwealth” made him “exactly the type of alien we are targeting with our ‘worst first’ policy.”

In Lawrence, 19-year-old Honduran national Stivenson Omar Perez-Ajtzalan was released by the Lawrence District Court on $7,500 bail after being charged with aggravated rape of a child with a 10-year age difference.

CBS also reported that two individuals charged with cocaine and fentanyl trafficking were released with bail set at $500 and $4,000.

During a speech at the Conservative Political Action Conference (CPAC) in February, Tom Homan addressed the state’s lack of cooperation with ICE, saying, “You said you doubled down on not helping the law enforcement officers of ICE. I’m coming to Boston, and I’m bringing hell with me.”


Last week, Homan followed through. On March 19, he posted on X that ICE and multiple federal agencies had conducted a five-day operation in the Boston area, resulting in 370 arrests.

“I made a promise at CPAC that I was going to Boston after reading about numerous illegal alien child rapists walking the streets of Boston and Massachusetts,” Homan wrote.

“Mayor Chu [sic] later testified that I was lying. Well, I traveled to Boston last Tuesday, as promised, and we kicked off a five day operation with ICE, FBI, ATF, DEA, US Marshals and DSS. These incredible men and women arrested a total of 370 Illegal aliens in Boston and surrounding areas.”

According to Homan, the majority of those arrested were “significant criminals,” including four wanted for murder, drug traffickers, child sex offenders, and others deemed public safety threats.

“ICE had to find and arrest these illegal alien rapists because Massachusetts and Boston are sanctuaries that refuse to cooperate with ICE,” Homan said.

“They would rather release these animals back into the community rather than honor ICE detainers or notify ICE when they are scheduled to be released.”

Speaking to Fox News Digital, Logan Trupiano of the Massachusetts Republican Party echoed Homan’s concerns, saying, “They’re not utilizing any empathy when they’re allowing illegal immigrants who were arrested for heinous crimes, particularly crimes against children, and released back in the community to re-offend.”

“It’s absolutely egregious, absolutely ridiculous, and there’s no decent argument against [deporting criminal illegals],” Trupiano said.

“All they’re really doing is just attacking the Trump administration and mischaracterizing the administration’s efforts as well as ICE.”
