U.S. Immigration and Customs Enforcement (ICE) arrested 35-year-old Honduran national Marvin Mateo-Alberto last week in a targeted enforcement operation after local authorities failed to honor an immigration detainer filed against him.
Mateo-Alberto faces serious criminal charges, including incest and aggravated sexual battery involving a child between the ages of 13 and 17.
ICE agents located and detained Mateo-Alberto during a multi-agency operation in Northern Virginia after he was released from the Fairfax County Adult Detention Center, despite a pending immigration detainer and an existing deportation order dating back nearly two decades.

ICE Enforcement and Removal Operations (ERO) officials say the decision to release Mateo-Alberto was the result of Fairfax County’s “Public Trust and Confidentiality Policy,” which restricts local law enforcement from cooperating with federal immigration enforcement.
The policy, in effect since 2021, bars county officials from notifying ICE or honoring detainers unless required by law or a judicial warrant.

Mateo-Alberto initially entered the U.S. illegally through Eagle Pass, Texas, in 2005 and was apprehended by Border Patrol.
He was released pending an immigration hearing and was later ordered deported by a U.S. immigration judge in April 2006 during the George W. Bush administration. That order was never carried out, as he was not in federal custody.
In January 2025, Fairfax County Police arrested Mateo-Alberto and charged him with incest and aggravated sexual battery involving a child.
The charges specifically included incest with a minor between the ages of 13 and 17 and aggravated sexual battery by a parent or guardian.

Following his arrest, ICE filed a detainer request with the Fairfax County Adult Detention Center, asking that Mateo-Alberto be held for transfer into ICE custody. That request was not honored.
“Marvin Mateo-Alberto stands accused of some very appalling and disturbing crimes and represents a threat to the children of our Virginia communities,” said ERO Washington Field Office Director Lyle Hott in a statement after the arrest.
“We cannot in good conscience allow Mr. Mateo to continue to potentially threaten other children in our neighborhoods.”
ICE agents apprehended Mateo-Alberto during a recent immigration enforcement operation in Fairfax County.
He was found riding in a pickup truck along with two other Honduran nationals, both of whom were also in the country illegally.
All three men were taken into custody by ICE agents. The arrest was documented by a news crew from ABC7, which accompanied federal agents during the operation.
ERO Washington Field Office Director Hott criticized the county’s policy of not honoring ICE detainers, stating it puts the public and law enforcement officers at risk.
“The refusal to honor lawful detainer requests undermines public safety and forces ICE officers to conduct at-large arrests, which carry a higher risk for everyone involved,” Hott said.
Mateo-Alberto remains in ICE custody as his immigration proceedings move forward.
ICE confirmed that several other individuals were taken into custody during the same operation, including individuals who were not on the original target list but were identified as being in the country illegally during the enforcement effort.
The case has sparked renewed debate over local non-cooperation policies with federal immigration authorities, particularly when involving suspects with violent or serious criminal charges.
ICE officials have repeatedly called for greater coordination with local law enforcement in cases involving individuals accused of serious offenses.
