Federal charges are reportedly being prepared against Rep. LaMonica McIver (D-NJ) following a May 9 incident in which she and two other Democrat lawmakers were seen on video breaching a U.S. Immigration and Customs Enforcement (ICE) detention facility in Newark, New Jersey.

The Delaney Hall detention center was the site of an unannounced visit led by the lawmakers and Newark Mayor Ras Baraka.

According to three anonymous sources who spoke to the New Jersey Globe, the Department of Justice plans to bring charges against McIver.

The exact nature of the charges has not yet been publicly disclosed, but interim U.S. Attorney Alina Habba is expected to announce the decision as early as Friday.

The report indicates that McIver may voluntarily surrender to authorities that same day.

McIver, along with fellow Democratic Reps. Bonnie Watson Coleman and Rob Menendez Jr., entered the ICE facility under what they claimed was an “oversight” visit.

The group was accompanied by Newark Mayor Ras Baraka, who has publicly stated that the facility lacks proper permitting. Baraka was arrested at the scene during the confrontation, but the lawmakers were not taken into custody at the time.

Body camera footage captured during the incident appears to show McIver pushing past a Department of Homeland Security (DHS) agent at the facility’s entrance and proceeding through the secured gates.

DHS agents on site attempted to prevent unauthorized entry, according to officials familiar with the matter.

The lawmakers’ actions have sparked discussions in Congress about potential disciplinary action.

Speaker of the House Mike Johnson (R-LA) addressed the issue this week, saying that multiple responses were being considered.

“Look, I think it’s pretty clear that the law was violated,” Johnson said.

He referenced a recent case involving a Wisconsin judge who was indicted by a federal grand jury for obstructing ICE enforcement efforts.

“You might have noticed the Wisconsin judge that was trying to conceal the illegal alien that was gonna be apprehended by ICE, a federal grand jury indicted [the] judge,” he said.

Johnson noted that the judge in that case faces up to six years in prison and $350,000 in fines for obstruction.

Drawing a comparison, he said, “What these House Democrats did is in that same vein of what the judge is being indicted for, so I think there’s some legal ramifications to play out here and we’ll see.”

While specific charges against McIver have not been detailed, the incident is likely to intensify debates in Congress over lawmakers’ conduct and their roles in immigration enforcement conflicts.

Among the disciplinary options being discussed in the House are censure, removal from committee assignments, and potentially expulsion.

Johnson acknowledged that expulsion would be a challenging process, given the current partisan balance in the House of Representatives.

The Department of Justice has not yet released an official statement, and neither Rep. McIver nor her office have commented on the report as of Thursday evening.

If charges are filed, it could mark a rare instance of a sitting member of Congress facing prosecution for interfering with federal immigration enforcement operations.
