Republican South Carolina Rep. Nancy Mace said she is filing a resolution on Wednesday to expel Democratic New Jersey Rep. LaMonica McIver from Congress following the Justice Department’s decision to charge McIver with allegedly assaulting law enforcement earlier this month.
“Assaulting federal agents is a crime, plain and simple,” Mace wrote in an X post Wednesday evening. “No one is above the law. The American people deserve better.”

Mace said she is not forcing a vote on the resolution, but instead will let the House Ethics Committee consider it, Axios reported. Mace’s push for McIver’s expulsion follows allegations that McIver assaulted a law enforcement officer based on body cam footage of her elbowing an Immigration and Customs Enforcement (ICE) officer outside a Newark immigrant detention facility. McIver, who has denied the allegations and instead says she was the one assaulted, responded to the explosion resolution in a post to X, writing, “In the South I think they say, ‘bless her heart.’”
Mace is not the only one taking action against McIver. Her colleague, Republican South Carolina Rep. William Timmons, introduced a resolution to censure her, as well as have the House Ethics Committee investigate her.
Republican Georgia Rep. Buddy Carter, who is running for Senate, has also introduced a resolution to strip McIver of her committee assignments, along with two other Democratic representatives.
