The Department of Homeland Security reaffirmed Wednesday that Kilmar Abrego Garcia, an illegal immigrant and alleged MS-13 gang member, has been permanently removed from the United States and “will never be on American streets again.”

As Fox News reported, Garcia, who was deported to El Salvador earlier this year, has become the subject of controversy after U.S. Rep. Glenn Ivey, D-Md., attempted to visit him in a Salvadoran prison on Memorial Day.

Ivey, who has called for a legal review of Garcia’s deportation, claimed in a video posted to X that he was denied access despite repeated diplomatic outreach.

“I’m the congressman who represents Kilmar, and I came all the way down from the United States after we contacted their ambassador, after we made formal requests through our ambassador to the El Salvadoran government, and we came here to visit him today,” Ivey said.

In response, DHS issued a firm statement via X rejecting the notion that Garcia’s deportation was unjust, calling the congressman’s advocacy “appalling.”

“Let us be crystal clear: Kilmar Abrego Garcia will never be on American streets again,” the agency stated. “Advocating for an illegal alien, MS-13 gang member, human trafficker and wife beater over ACTUAL Maryland constituents victimized by illegal alien crime is appalling.”

Democrats, including Ivey, have argued that Garcia, whom they describe as a “Maryland man,” was denied due process before his deportation. Ivey has called on Homeland Security Secretary Kristi Noem to present courtroom evidence verifying Garcia’s immigration status.

The Trump administration has pointed to existing court records and immigration violations as the legal foundation for Garcia’s removal.

It has cited documentation linking Garcia to MS-13 gang activity, human trafficking operations, and domestic abuse allegations involving his wife, Jennifer Vasquez Sura.

Since Garcia’s removal, Democratic lawmakers have made multiple attempts to conduct wellness checks on him at the El Salvadoran facility where he is being held. These efforts have reportedly been blocked by Salvadoran officials.

Fox News Digital reached out to Rep. Ivey’s office for comment but has not received a response.

DHS officials remain adamant that the case was handled according to law, and say the focus should remain on protecting American communities from individuals with serious criminal ties.
