Biden Family Pardons Under DOJ Investigation as Autopen Scandal Grows [WATCH]

The U.S. Department of Justice has opened a formal investigation into a series of pardons issued by Joe Biden in the final days of his administration, with a particular focus on his mental capacity at the time and the possible unauthorized use of an autopen device.

Ed Martin, the current pardon attorney and head of the DOJ’s task force on government weaponization, announced the investigation in an internal email to department staff on Monday, according to documents reviewed by Reuters.

The inquiry will assess whether Biden was competent when issuing a series of high-profile pardons and commutations and whether others may have exploited his condition by authorizing official actions on his behalf.

The investigation will focus heavily on the blanket pardons granted to several members of the Biden family just 48 hours before President Donald Trump was sworn in for a second term.

Biden issued full and unconditional pardons—retroactive to 2014—for James B. Biden, Sara Jones Biden, Valerie Biden Owens, John T. Owens, and Francis W. Biden. Hunter Biden had received a similar pardon a month earlier.

In addition to the family pardons, Biden commuted the sentences of 37 out of 40 individuals on federal death row, converting their sentences to life imprisonment without parole.

The series of decisions drew immediate scrutiny, especially in light of concerns surrounding Biden’s cognitive state, which had become a topic of national discussion during the 2024 election cycle.

Martin stated in the internal DOJ communication that the probe will explore “whether President Biden was competent and whether others were taking advantage of him through use of AutoPen or other means.”

The investigation was prompted in part by whistleblower testimony. Martin told journalist Mark Halperin that a senior Democratic official had recently approached him with concerns about individuals allegedly controlling access to Biden in his final months in office.

“I had a whistleblower in my office 10 days ago — senior, senior Democrat — saying, ‘Look, it was these three people that controlled access, and they were making money off of it,’” Martin said.

While the claims have not yet been independently corroborated, Martin identified three key figures alleged to have held influence over presidential actions: former White House Chief of Staff Ron Klain, senior advisor Anita Dunn, and former Obama attorney Robert Bauer.

Martin also named two additional individuals described as “dominant characters” during that time—Steve Ricchetti, Biden’s former counselor, and First Lady Jill Biden.

The investigation has renewed speculation over whether Biden himself authorized major policy decisions and executive actions in the final phase of his presidency.

A government watchdog group last week released findings from a review of executive orders issued since 2021.

The group, which examined a number of climate-related orders signed using autopen, reported “no evidence that Biden ordered it, directed it, or was even aware it was happening in his name,” according to its executive director.

CNN anchor Jake Tapper, who recently published a book on the Biden-Harris administration, suggested the alleged deception regarding Biden’s competency may surpass past presidential scandals in significance.

“It might be even worse than Watergate in some ways,” Tapper reportedly stated.

Martin emphasized that the investigation is still in its early stages, and no formal accusations have been made against any individuals.

The DOJ task force is expected to subpoena documents and communications related to the issuance of pardons and executive orders.

Calls for congressional hearings have already begun, with some lawmakers demanding public testimony from top officials who were close to Biden during his presidency.

No official comment has yet been issued by the Biden family or any of the individuals named in the whistleblower’s allegations.
