Kilmar Abrego Garcia, whose detention in El Salvador triggered a wave of political outcry from Democratic lawmakers, has been returned to the United States—this time, to face serious federal charges unrelated to the earlier controversies.

According to an indictment unsealed upon his return, Abrego Garcia is facing new charges for conspiracy to transport illegal aliens, including individuals with ties to the violent transnational gang MS-13.

The charges mark a sharp turn in the narrative that once saw him celebrated by prominent Democrats and media outlets as a victim of overreach by U.S. immigration policy.

Despite the nature of the charges, some Democratic leaders have continued to defend Abrego Garcia publicly.

On CNN’s Anderson Cooper 360, Sen. Chris Van Hollen (D-MD) suggested that President Donald Trump owed Abrego Garcia an apology—statements that were met with swift criticism from conservative commentators.

Republican strategist and CNN contributor Scott Jennings strongly pushed back during the segment, calling out Van Hollen and others for what he characterized as selective outrage and misplaced sympathy.

“I suspect that Maryland Senator Chris Van Hollen, when he heard that Saint Abrego Garcia was coming back, took a shower, put on his nice suit, got on OpenTable, found out what maybe party of two reservation they could get for tonight—so they could continue the bromance they started when he went back to visit Saint Abrego in El Salvador,” Jennings said on the panel.

The debate intensified as other panelists questioned the legal status of illegal entry into the United States.

CNN contributor Bakari Sellers appeared to downplay the criminality of entering the U.S. illegally.

Under federal law, specifically 8 U.S.C. § 1325, it is a crime to enter the United States illegally.

While unlawful presence alone, such as overstaying a visa, is typically a civil offense, entering the country without inspection remains a criminal misdemeanor.

Jennings responded directly to those comments, noting the legal distinction and adding that the current charges against Abrego Garcia go far beyond immigration violations.

“Number one, he gets convicted of this stuff, and goes to prison for a long time,” Jennings said on-air.

“Number two, he gets acquitted and goes back to El Salvador… Either way, it’s what the White House said all along. There’s no future where ‘the Maryland man’ goes back to Maryland to live quietly in the suburbs. That is over.”

Abrego Garcia became a political flashpoint earlier this year after being detained in El Salvador and later released.

Democratic lawmakers, including Sen. Van Hollen, publicly advocated for his return to the United States and criticized the Trump administration for what they described as political targeting.

However, the Department of Justice has confirmed that the current charges stem from a separate investigation involving immigration crimes tied to MS-13 operations.

Though Abrego Garcia has not been charged in connection with accusations made by his wife—who filed for two protective orders—those issues remain in the public spotlight as the new federal case moves forward.

Jennings later addressed the ongoing debate on social media, writing on X, “I’m like Bill Murray in Groundhog Day. Someday I’ll find a way out of this conversation about Saint Abrego Garcia. Today isn’t it.”

As the legal proceedings advance, critics have pointed to the Democrats’ earlier praise of Abrego Garcia as politically reckless in light of the charges now brought against him.
