George Washington University law professor Jonathan Turley told “Fox and Friends” co-host Lawrence Jones Monday that adjudicated MS-13 member Kilmar Abrego Garcia would not like returning to the United States.

Attorney General Pam Bondi announced Abrego Garcia would return to the United States to face trial after federal authorities secured an indictment on human trafficking charges. Turley drew a comparison to a baseball player caught in a rundown when discussing Abrego Garcia’s situation. (RELATED: Jonathan Turley Skewers Judge For ‘Virtue Signaling’ From Bench)

“This is not the guy that National Public Radio described as living quietly in Maryland,” Turley told Jones. “The indictment is really incredible reading, over 100 trips and the allegation that he was a central part in a massive human smuggling operation. The irony here, Lawrence, is that the United States is now the last place Abrego Garcia wants to be. He’s like a runner caught between first and second. He is going to get tagged out either way, but by getting back to second he is looking at over a decade of jail potentially.”

The Trump administration released a 13-page dossier detailing the evidence against Abrego Garcia in April, which included rulings from immigration courts that found he was a member of the El Salvadoran prison gang.

Turley also discussed Democratic Gov. Gavin Newsom of California’s threat to sue the Trump administration over the deployment of 2,000 National Guard personnel to address riots stemming from raids by United States Immigration and Customs Enforcement (ICE) targeting illegal immigrants.

“What Newsom is arguing is technically the request had to go through his office and required his calling out the National Guard. Whether that’s enough for the federal court to delay the implementation of the order, we will have to see,” Turley said. “Certainly there have been plenty of these cases where they have forum shopped and found very favorable judges.”

“In the end, the president has the authority to call out the national guard and it will happen,” Turley continued. “In fact, what Newsom is doing is going to escalate it further. The president is operating under Title 10 which allows him to call out the National Guard to enforce federal law. That’s what they did during the desegregation period of when local authorities refused to comply with federal law. President Donald Trump issued several executive orders to address illegal immigration and border security, including designating Mexican drug cartels, the Venezuelan prison gang Tren de Aragua (TdA) and MS-13 as foreign terrorist organizations upon taking office Jan. 20. Trump invoked the Alien Enemies Act of 1798 to speed up the deportation of gang members on March 15.
