U.S. District Judge Brian Murphy, appointed by former President Joe Biden in 2021, is facing intense scrutiny after refusing to lift his injunction on deportations of criminal illegal aliens—despite a 6–3 Supreme Court ruling that cleared the way for President Donald Trump’s administration to proceed with removals to third-party countries, as reported b y The Gateway Pundit.
Murphy ruled Monday evening that his May 21 order blocking the deportation of certain violent foreign nationals remains in effect, even after the Supreme Court granted the Trump administration’s emergency request to lift the injunction.
The ruling applies to several individuals from Laos, Vietnam, and Cuba, who were set to be transferred to South Sudan, according to federal authorities.

In a brief order, Murphy stated, “The Court’s May 21, 2025 Order on Remedy remains in full force and effect, notwithstanding today’s stay of the Preliminary Injunction.”
His decision effectively maintains protection from removal for eight criminal aliens currently detained at Camp Lemonnier in Djibouti.
Murphy cited Justice Sonia Sotomayor’s dissent in the Supreme Court decision to justify his stance, though the majority of the Court disagreed.
The emergency ruling was supported by Chief Justice Roberts and Justices Thomas, Alito, Gorsuch, Kavanaugh, and Barrett. Justices Sotomayor, Kagan, and Jackson dissented.

The Supreme Court’s action allows the Trump administration to continue enforcing long-standing federal immigration law by deporting non-citizens convicted of serious crimes to any country willing to accept them.
Trump senior advisor Stephen Miller addressed the situation during an appearance on Hannity Monday night.
“Yes, this is an incredible victory — the Supreme Court win,” Miller said.
“It allows President Trump, as the law has long said but the courts have blocked, to send illegal aliens convicted of rape, murder, homicide, assault, battery, and crimes against children to any country around the world that is willing to accept them.”
Miller confirmed the administration is preparing to respond to Murphy’s defiance.
“The only thing I have to share tonight, Sean — and this is a bit of breaking news — is that the district court judge in Boston has said he’s going to defy the Supreme Court’s ruling,” Miller said.
“So expect fireworks tomorrow when we hold this judge accountable for refusing to obey the Supreme Court.”
