A Mexican national living in the United States illegally is facing a federal immigration detainer after he was arrested for allegedly killing a Louisiana man in a drunk driving crash while the victim was mowing his lawn, as reported by the New York Post.

Roberto Romero-Hernandez, 34, is being held at the Avoyelles Parish Detention Center following his arrest on August 3. He was charged with vehicular homicide, driving while intoxicated, careless operation, driving without a license, and operating a vehicle with expired registration.

The victim, 59-year-old Rickey Maddox of Alexandria, Louisiana, was riding a Kubota lawn mower on the shoulder of Louisiana Highway 1 around 9 p.m. when Romero-Hernandez reportedly veered off the road in a 2014 Chevrolet Silverado and struck him, according to Louisiana State Police.

Maddox was transported to a nearby hospital with life-threatening injuries and was later pronounced dead. Romero-Hernandez was not injured in the crash and was taken into custody hours later.

The Department of Homeland Security confirmed that U.S. Immigration and Customs Enforcement (ICE) filed a federal detainer to ensure Romero-Hernandez remains in custody following any local legal proceedings.

“This criminal illegal alien’s reckless decision to drink and drive killed an innocent man,” said Assistant DHS Secretary Tricia McLaughlin.

“The senseless tragedy should have never happened because Romero-Hernandez should have never been in our country… Every death caused by an illegal alien is preventable.”

ICE did not release details on how or when Romero-Hernandez entered the United States. Jail records indicate he remains in custody as of this report.

The federal detainer ensures that Romero-Hernandez will be transferred to ICE custody for immigration proceedings if he is released from local jail on bail or after serving any potential sentence.

The move is intended to prevent him from evading deportation proceedings or reentering the community.

The crash has reignited concerns over the public safety risks posed by illegal aliens, particularly those with prior offenses or who enter the country without documentation.

According to DHS, Romero-Hernandez had no license or legal authorization to operate a motor vehicle in the U.S.

Authorities have not confirmed whether Romero-Hernandez has any prior criminal history, but the charges related to the incident — including driving under the influence and vehicular homicide — have elevated the case to the attention of federal officials.

The investigation into the fatal crash remains ongoing.
