The House Oversight Committee plans to withdraw its subpoena for former Federal Bureau of Investigation (FBI) Director and special counsel Robert Mueller, telling the Daily Caller that Mueller has health issues that “preclude him from being able to testify.”

“We’ve learned that Mr. Mueller has health issues that preclude him from being able to testify. The Committee intends to withdraw its subpoena,” a committee spokesperson told the Caller.

An Aug. 6 report from Real Clear Investigations indicated that Mueller has been residing in a memory care facility for years. (RELATED: REPORT: Former Special Counsel Robert Mueller Allegedly Living In Memory Care Facility)

News of Mueller’s declining health came just two days after House Oversight Chairman James Comer revealed that subpoenas had been issued to high-profile political figures and officials — including Mueller — calling on them to testify about the FBI’s handling of the Jeffrey Epstein investigation.

Former Attorney General William Barr is scheduled to be the first witness in the Epstein probe, testifying before the committee on Monday.

Comer’s subpoenas target several top former officials, including former FBI Director James Comey and former Attorneys General Loretta Lynch, Eric Holder, Jeff Sessions, Alberto Gonzales and Merrick Garland. (RELATED: Alan Dershowitz Shares What Worries Him Most About Epstein Case Files)

The letters outline their connection to the Epstein investigation and request any records or testimony related to what they knew about the FBI’s handling of the case.
