Case Dismissed: County DA Says He Can’t Prove Disorderly Conduct by Nick Sortor

Last week, Portland Police finally bestirred themselves to make a few arrests outside the ICE facility which has been besieged on a nightly basis by Antifa. Unfortunately for them, one of the people they decided to arrest was independent journalist Nick Sortor.

As I pointed out last week, no one who was there seemed to know why Sortor had been arrested and Sortor himself would later say that the police didn’t seem to know either when he asked. Despite this they attempted to charge him with disorderly conduct, something that could easily apply to many of the Antifa goons outside the ICE facility that Portland PD has been ignoring for months.

Don’t forget, this arrest came just a day after conservative reporter Katie Daviscourt was hit in the face with a flag pole, giving her a black eye. She quickly pointed out her assailant to Portland PD and they let the person walk away.

The reaction to this targeted arrest of Sortor was swift. AG Pam Bondi announced she was launching a DOJ investigation into the Portland PD. Assistant AG Harmeet Dhillon sent Portland PD a letter demanding documents related to the arrest.

Yesterday, Sortor vowed he would not accept a plea deal as he hadn’t done anything wrong. He released video of the incident in question which showed him being hassled and knocked to the ground.

Tomorrow at 2pm PT, I will be arraigned in Portland for “Disorderly Conduct II”

I will NOT take a plea deal of any kind. Because I did NOTHING wrong. I will fight this until the end, and expose Portland Police in the process

Earlier today, Sortor’s legal team demanded information about Portland PD’s treatment of Antifa. He was preparing to fight this.

A short time later, the Multnomah county DA announced he would be declining to charge Sortor with a crime, saying that after reviewing the evidence he couldn’t prove disorderly conduct. Here’s what he wrote in his memo about declining the charges.

On October 2, 2025, Portland Police officers arrested Nicholas SORTOR, Angella Lyn DAVIS, and Son Mi YI for Disorderly Conduct II for an altercation outside the Portland ICE facility…

On this date Portland Police had deployed officers to monitor a medium sized demonstration (estimated at 50-75 people) in the immediate vicinity of the ICE facility. This involved individuals demonstrating against ICE and the federal government (among whom were DAVIS and YI) and individuals from the other side of the political spectrum documenting and/or counterdemonstrating (among whom was SORTOR). Based on the information immediately available on scene, I agree that probable cause existed as to all three. However, with the benefit of the video footage of the incident, I conclude that charges cannot be proven against SORTOR.

SORTOR was on scene recording video of the demonstrators, including shining lights at them in furtherance of this. Immediately prior to the incident here, SORTOR is walking from the street to the sidewalk when he is confronted by a person in all black and a verbal exchange ensues. During this time LI is observed using an open umbrella to push SORTOR. SORTOR pulls the umbrella out of her hands. The crowd converges on him and DAVIS is in it, getting within inches of SORTOR and appears to swing something at him. SORTOR attempts to get away and LI pushes him into the bioswale (a depressed drainage opening next to the street), where the crowd surrounds him and appears to try to prevent him from getting out.

I know that Portland Police Bureau has substantial experience managing demonstrations and that their approach is to monitor and make targeted intervention if the conduct of the crowd, or individuals in it, tip to property damage or violence rather than escalating matters with a riot line. In this instance, after observing what was described as a ”scrum” between DAVIS, YI, and SORTOR, Portland Police intervened and made targeted arrests of all three individuals to defuse and deescalate the situation.

DAVIS and YI provably engaged in ”violent, tumultuous, and threatening behavior” as required by the Disorderly Conduct II statute and, as such, will be charged. As to SORTOR, any physical contact he had with other persons was defensive in nature, reasonable under the circumstances, and therefore justified by ORS 161.195. SORTOR’s conduct of attempting to video record and shine a bright light at the other side, while certainly provocative, is not criminal and does not give rise to any legally justifiable ability to respond with force.

Separately, there is video of SORTOR taking a burning flag from an individual during this episode and putting the flames out. This conduct does not support any criminal charges given the particular context in which it occurred.

Prosecution is declined.





This is clearly the right decision but the backstopping of the police decision to arrest Sortor in the first place feels like politics. “In this instance, after observing what was described as a ‘scrum’ between DAVIS, YI, and SORTOR, Portland Police intervened and made targeted arrests of all three individuals to defuse and deescalate the situation.” 

That is just BS. According to several witnesses and Sortor himself, he went over to the police after being attacked for his own safety. He then spent a few minutes calmly talking to them before he was arrested. In other words, he had already de-escalated the situation as much as possible by moving away and seeking the police. He was not stirring up a fight or shouting at anyone. Police arrested him anyway.

Hopefully we’ll find out from Harmeet Dhilon whether someone made a call to the DA asking for help to get this hot potato off their laps. Sortor is still saying this is “only the beginning” of this, despite the decision not to prosecute.
