President Trump on Tuesday evening issued a warning to former FBI Director James Comey and New York Attorney General Letitia James after a federal judge dismissed the criminal cases brought against them, as reported by The Gateway Pundit.
The cases were dismissed Monday by U.S. District Judge Cameron McGowan Currie, a Clinton appointee, who ruled that the appointment of U.S. Attorney Lindsey Halligan violated the Appointments Clause of the Constitution.
The ruling dismissed the cases without prejudice, meaning the dismissals are temporary and can be revisited.
Judge Currie also ruled that Attorney General Pam Bondi’s attempt to ratify Halligan’s actions was “ineffective.”
Following the decision, Comey publicly celebrated the ruling and criticized President Trump.
In a video posted to Instagram, Comey accused the President of misusing federal law enforcement authority.
“A message has to be sent that the president of the United States cannot use the Department of Justice to target his political enemies,” Comey said.

He continued, “I don’t care what your politics are, you have to see that as fundamentally un-American and a threat to the rule of law that keeps all of us free.” Comey then said he expects additional action from President Trump in the future.
“I know that Donald Trump will probably come after me again, and my attitude is going to be the same. I’m innocent, I am not afraid, and I believe in an independent federal judiciary,” he said.
Letitia James also celebrated the ruling, though she did not provide extended public comments in the immediate aftermath.
The cases against both officials had been watched closely due to their high-profile roles in investigations involving President Trump dating back to prior administrations.
President Trump addressed the ruling during remarks to reporters aboard Air Force One late Tuesday.
He said the judge’s ruling did not close the matter.
“They got out on a technicality, and you’ll see what happens from here on,” Trump said.
He added, “Let’s see what happens over the next week.”
The dismissal without prejudice leaves the door open for further legal action, depending on how the Justice Department proceeds following the ruling on Halligan’s appointment.
The decision also places focus on the constitutional questions raised by Judge Currie’s opinion, particularly regarding the validity of actions taken by federal officials whose appointments are later found to be in conflict with the Constitution.
As of Tuesday night, neither the Justice Department nor the offices of Comey or Letitia James had issued additional statements beyond their initial reactions.
