A federal judge appointed by former President Barack Obama declined to extend the sentence of an illegal alien convicted of sexually assaulting a woman with cerebral palsy in Michigan, a decision that has drawn sharp criticism from Department of Homeland Security officials and senior Trump administration advisers, as reported by the Gateway Pundit.

According to a report by The Detroit News published Friday, Edys Renan Membreño Díaz, a 30-year-old illegal alien from Honduras, could be released from federal prison as early as July 2028.

Díaz pleaded guilty in 2022 to sexually assaulting a disabled woman in the laundry room of her apartment building in Michigan. The victim has cerebral palsy and cognitive delays.

Court records show Díaz had been caught entering the United States illegally at least seven times since 2019. Despite that history, U.S. District Judge Judith Levy sentenced him in August 2024 to time served for the sexual assault conviction.

Levy had the option to add up to two additional years to Díaz’s sentence for immigration-related offenses, but declined to do so.

In her sentencing remarks, Levy praised Díaz, referring to him as an “ambassador for living up to our immigration restrictions” and citing his “family devotion and willingness to perform work that it claimed Americans find undesirable,” according to the report.

The decision prompted a response from Assistant Homeland Security Secretary Tricia McLaughlin, who criticized the ruling in a statement posted Saturday.

“Edys Renan Membreño Díaz, a criminal illegal from Honduras who illegally entered our country 7 times, was convicted of raping and sodomizing a woman who has cerebral palsy and cognitive delays,” McLaughlin wrote.

“He attacked her and dragged her into her apartment building’s laundry room.”

“He was sentenced 3 years ago and could be released from prison as early as July 2028,” she added.

“But, the U.S. District Judge Judith Levy refused to sentence him to 2 more years for immigration crimes and called this monster a future ‘ambassador for living up to our immigration restrictions.’”

McLaughlin continued, “This Obama-appointed judge went on to praise him for ‘family devotion and willingness to perform work that it claimed Americans find undesirable. Truly wicked.’”

Donald Trump’s White House Deputy Chief of Staff for Policy Stephen Miller, also weighed in on the case, condemning the decision and the broader implications of the ruling.

“When foreigners invade our territory and violently r*pe defenseless women, these are war crimes. Democrat judges give them aid, shelter, not because they are ‘soft’ but because they support the end game: the forced humiliation, dismantlement, domination, and destruction of the West,” Miller wrote.

The case has renewed scrutiny of federal sentencing decisions involving illegal aliens convicted of violent crimes, particularly when judges decline to impose additional penalties for repeated immigration violations.

Díaz remains in federal custody and, absent further sentencing changes, is eligible for release in July 2028.
