We’ve Lost The All-Wise Judges: Trump Derangement Syndrome Knows No Bounds

Federal judge Ana Reyes blocked the Trump administration from ending Temporary Protected Status (TPS) for about 350,000 Haitians on Monday.

“Plaintiffs charge that [Department of Homeland Security (DHS) Secretary Kristi Noem] preordained her termination decision and did so because of hostility to nonwhite immigrants. This seems substantially likely,” writes Reyes.

Reyes does not offer proof of Noem’s supposed racism, beyond the fact that Haiti is a “majority nonwhite country.” (RELATED: Kristi Noem’s Job Is Reportedly Safe Thanks To Melania Trump) 

Reyes takes a snarky, Slate-like tone totally unbefitting a judge. She refers to President Donald Trump’s reported characterization of Haiti as a “shithole” country, and in a footnote, adds, “Alexander Moritz Frey was the first to use ‘shithole’ as a descriptor of a ‘wretched place,’ doing so in his seminal antiwar novel, The Cross Bearers (1930). Let’s indulge Reyes. 

If a “shithole” is a “wretched place,” Haiti certainly qualifies. Reyes argues as much in her opinion. She cites Haiti’s 2010 TPS designation, which claims Haiti suffers from “a housing shortage, a cholera epidemic, limited access to medical care, damage to the economy, political instability, security risks, limited access to food and water, a heightened vulnerability of women and children, and environmental risks.” Reyes refers to Haiti’s high rates of chronic malnutrition, dirty water, and violent protests.

None of these qualities suggest the United States has a duty to open its doors to Haitians, of course. But I note Reyes’ self-contradiction because the judge is seemingly unconcerned with logic. Emotion seems to be her guide. 

“There is an old adage among lawyers. If you have the facts on your side, pound the facts. If you have the law on your side, pound the law. If you have neither, pound the table. Secretary Noem, the record to-date shows, does not have the facts on her side—or at least has ignored them. Does not have the law on her side—or at least has ignored it. Having neither and bringing the adage into the 21st century, she pounds X,” Reyes writes.

“Kristi Noem has a First Amendment right to call immigrants killers, leeches, entitlement junkies, and any other inapt name she wants. Secretary Noem, however, is constrained by both our Constitution and the APA to apply faithfully the facts to the law in implementing the TPS program. The record to-date shows she has yet to do that.”

At least Reyes restrained herself from attaching a picture below her signature, in the style of U.S. District Judge Fred Biery. (RELATED: What To Know About Fred Biery, Judge Behind Craziest Court Order Of Trump’s Second Term) 

Biery ordered the release of Adrian Conejo Arias, and his five-year-old son, Liam Conejo Ramos, from an immigration detention facility in Texas on Saturday. 

The judge attached a photo of Ramos to his order, and suggested the Trump administration was complicit in “traumatizing children.” He accused the Trump administration of being ignorant of the Declaration of Independence and implied that some in the administration possessed a “perfidious lust for unbridled power[.]” 

Biery signed his order “this 31st day of February, 2026,” a non-existent date. 

The judge is somewhat infamous for issuing flamboyant opinions. Biery reportedly barred high school students from asking the audience to join them in prayer in 2011, a decision which was swiftly overturned by an appeals court. 

There is an epidemic of impropriety among the judiciary.

Supreme Court Justice Ketanji Brown Jackson attended the Grammys on Sunday, having been nominated in the audiobook category for her 2025 memoir, “Lovely One.” Celebrities used the awards ceremony as an opportunity to parrot shallow political slogans and perform provocative dances. The former item is the greater offense, given the code of conduct for Supreme Court justices. 

“A JUSTICE SHOULD AVOID IMPROPRIETY AND THE APPEARANCE OF IMPROPRIETY IN ALL ACTIVITIES,” reads the code. 

“A Justice should not allow family, social, political, financial, or other relationships to influence official conduct or judgment. A Justice should neither knowingly lend the prestige of the judicial office to advance the private interests of the Justice or others nor knowingly convey or permit others to convey the impression that they are in a special position to influence the Justice.”

Regardless of Jackson’s motivations for attending the Grammys, hobnobbing with left-wing celebrities would seem to create the appearance of impropriety. 

The crisis of decorum at the Supreme Court is so severe, in fact, that Chief Justice John Roberts has reportedly imposed nondisclosure agreements on employees. An employee (or employees) tipped off the media to the Supreme Court’s opinion in Roe v. Wade in 2022. 

A good sign of a fractured social contract is increasing paperwork. What was once a social norm, enforced by the clerks’ own sense of honor, is now a legally-binding obligation.
