It’s Time to Stop Some Illegal Aliens From Having More Gun Rights Than Americans

I don’t agree with how police officers have more gun rights than ordinary Americans. I get it, at least in many cases. Their job makes them enemies. I went to a small, less-than-elite private school for high school because my father didn’t want me in the same public high school as a lot of the people he arrested. It’s kind of the same energy, only on a city or statewide landscape.

I get it, even if I disagree with it.

But thanks to the Law Enforcement Officers Safety Act, or LEOSA, sworn officers can carry in any state in the nation. Retirees can as well, just so long as they keep up their handgun qualifications.

And, as has been shown in the past, there are illegal aliens who are sworn police officers in many states, which also happen to be anti-gun. And Gun Owners of America has an issue with that.

These cases of illegal immigrants working as armed law enforcement have drawn attention to a glaring issue with current federal law. While there are nine federal categories of persons prohibited from possessing firearms and ammunition,[v] only one of these prohibitions currently applies against police.[vi] In fact, these prohibitions do not apply to anyone carrying firearms or ammunition working for the federal government.[vii]Title 18 Section 925(a)(1) clearly states that:

“[The prohibited person categories] shall not apply with respect to the transportation, shipment, receipt, possession, or importation of any firearm or ammunition imported for, sold or shipped to, or issued for the use of, the United States or any department or agency thereof or any State or any department, agency, or political subdivision thereof.” 

Therefore, 18 U.S.C. 925(a)(1) means it is currently 100% legal for an illegal immigrant to possess a firearm as a police officer as far as federal gun law is concerned, because the prohibited person categories[viii] do not apply.

The Stop Illegal Alien Cops Act Would Protect Gun Owners from Disarmament by Foreigners—Anti-gun states and law enforcement agencies are intentionally hiring and arming illegal aliens—who cannot otherwise own firearms—to enforce unconstitutional gun control laws, including “red flag” gun confiscations and so-called “assault weapons” bans. It is frightening that the governments of California, Illinois, Massachusetts, Maine, and perhaps others are using illegals to infringe on the right of the People to keep and bear arms. This unacceptable state of affairs renders Americans less able to defend themselves from a tyrannical government. It is a threat to liberty to allow large numbers of armed foreigners—who do not have Second Amendment rights—to participate in the disarmament and infringement of the People’s Second Amendment rights.

For once, the bill is a pretty simple read. In fact, GOA could put the whole thing up on X.

Now, even if I’m willing to look the other way on illegal immigration and shrug off police officers being permitted to carry in all kinds of places I can’t and in states that would never recognize my permit, the idea of illegal aliens who can’t lawfully own a gun being granted far more gun rights than you and I enjoy is still a bridge too damn far.

Of course, they shouldn’t be employed in law enforcement or correctional positions in the first place, but that’s a separate topic.

Note, though, which states are expressly named as allowing illegals in law enforcement. Of those, only Maine had anything approaching a pro-gun reputation, and that was only until the Lewiston shooting tilted everything there.

These are states that don’t trust you to exercise your Second Amendment rights responsibly, and they’re not just giving guns to people who broke the law to get into this country, but, based on federal law, allowing them far more gun rights than actual citizens get.

This is the perfect time to yell, “It’s an outrage!”

That’s because this is. This never should have been permitted.

If anti-gunners try to pretend they understand us, remember how many are totally cool with illegal immigrants getting the benefits of LEOSA while we’re lucky if we can even step outside lawfully while armed in some of these states.
