Texas Attorney General Ken Paxton announced that his office has filed a lawsuit against ActBlue in Tarrant County, Texas, following a multi-year investigation into the fundraising platform’s compliance with election laws.
The lawsuit, filed in Fort Worth, alleges that ActBlue misled both Congress and the public while failing to follow federal and state requirements designed to prevent improper or illegal political donations.
During an exchange with commentator Benny Johnson, Paxton confirmed the legal action and outlined the basis for the case.
“ I assume you’ve heard of ActBlue. We just filed a lawsuit this morning in Tarrant County, which is in Fort Worth, against ActBlue. We’ve been investigating them for for several years. We actually turned over some information to the FEC, the Federal Election Commission in 2024 obviously, that was during the Biden administration. Nothing occurred. But since that time, they’ve been in front of Congress. Their lawyers have admitted that they that they misled the public, that they misled Congress and that they actually didn’t have safeguards in place to prevent people from giving donations and other people’s names from taking foreign donations. There’s a lot of issues with compliance that they have not followed, and yet they told Congress that they had, and they’ve represented to us that they have. And so we file a lawsuit. We believe that they have misrepresented to us and to the people of this state, that they’re actually raising money illegally, and it is have it has a dramatic impact on elections, that when foreigners can donate money and they can take money from people that they’re not disclosing, they’re completely violating our laws, and they are impacting our elections. So we filed this lawsuit today, and we hope to get to the bottom of this and stop this from happening, and hold ActBlue accountable for their violations of least state law. We can’t stop them from violating federal law.”

Paxton said his office’s findings were based in part on direct testing of the platform’s donation system.
“Well, first of all, they confessed it in front of their lawyers, confessed it and said they willingly and knowingly violated federal law. Second of all, I we, my office, has registered in a way that you shouldn’t be able to register to give money on ActBlue. Now, we didn’t get a lot of money. We just wanted to test the system, and we were able to to register and give money on ActBlue without following appropriate disclosure guidelines, knowing who we were. So we know for a fact, because we were able to do it, that they are not following federal and state law.”
Paxton described how investigators conducted the test using the platform’s public interface.
“Yeah, so I just had some of my investigators, of my lawyers, give money to ActBlue, through, through, through their you know website, and they did it without disclosing the proper information, and we were able to demonstrate that they are not that they are not following federal and state law. It’s shocking to me that we haven’t already pursued this, but the Feds under the Biden administration completely ignored this, and they, I believe, knew that ActBlue was violating federal law, and as a result, Blue has raised billions of dollars for liberal causes, Liberal Democrats.”

Paxton also cited additional concerns about how donations are processed, including methods that do not require clear identification of donors.
“Well, so so they are doing it other ways as well. They’re using gift cards that do not identify debit cards that do not identify who the donor is. They’re using Venmo and some other types of platforms to give without identifying who the people are. So it’s not just that they’re using fake names. They’re they’re they’re sending these gift cards in without having any name. So look, it’s, it’s, it’s a huge problem. And this is being this is one of the most active sites for Democrats, maybe the most active site in US history, for raising money for for for liberal Democrats. And that that’s a problem if this is being funded largely through illegal donations, particularly illegal donations from foreign countries. So we have foreign actors who are influencing our elections and directing elections that they want, instead of what US citizens would prefer.”
When asked about potential penalties under Texas law, Paxton said enforcement would likely be civil unless local prosecutors pursue criminal charges.
“So we have no criminal authority that would local district attorney would have to take that up, whether they would do that. Who knows is, we have a lot of district attorneys in the bigger counties that are controlled by George Soros, and they would never follow up on this, but we do have some Republican days in smaller counties, so we have to follow up with our civil law, which is, we hold them accountable for violating civil law, and we have, we have penalties. Violations of these laws amount to large penalties depending on how many people were affected, and the more people were affected, the larger those penalties can be.”
Paxton said his office previously referred findings to federal regulators but did not see action taken.
“That’s a great question. I know for a fact that they had the information we had they, you know, Congress heard the same thing we heard. And we, of course, referred this to the FTC Federal Election Commission back in 2024 after our 2023 investigation, pulled up the fact that we thought that federal law was not being followed. Obviously we can’t enforce that. All we can do is refer it. So we did that, and nothing happened. So I don’t, I can’t explain that, other than the fact that I the Biden administration clearly didn’t want to do anything with it, and I don’t know if it got buried there. And, you know, the current FEC doesn’t have knowledge of our referral, but it’s there.”
Johnson introduced the interview by noting the development.
“Production team is telling me you have massive news to break. Perhaps it just broke on the internet, a huge lawsuit that you have filed against ActBlue. The floor is yours, sir.”
Later in the exchange, Johnson pressed Paxton on the scope of the issue and the implications if the allegations are proven.
“So you believe that this is happening across the country. This is just like the biggest political money laundering scheme in history.”
Paxton responded that the full extent would be determined through the legal process.
“It could be the largest we’ve ever seen. We will find out in litigation, through discovery, hopefully, exactly the extent of how big this is, but the numbers are large, and if they are not following federal law, I think some of the suspicions that people have had for a long time, some of the ones you just mentioned that they straw people, fake names, I think that’s very likely happening.”
Johnson also questioned why federal agencies had not taken action.
“Yeah, but it’s been, like nearly two years of the Trump administration. So why haven’t they done anything about it?”
Paxton said his office cannot compel federal enforcement.
“I don’t, I don’t have an answer for that. I don’t know if they just that’s, that’s, I cannot answer that question. That is that really in their purview, we can refer we can’t force any federal action on any particular issue.”
