Republican Ohio Rep. Max Miller’s attorneys have admitted the GOP lawmaker misled court officials about a key witness in a domestic violence case with his ex-wife.

Miller’s attorneys acknowledged in a court filing that he fabricated details—both in sworn statements and during a hearing—to support a protection order against his ex-wife, Emily Moreno, the daughter of Republican Ohio Sen. Bernie Moreno. This prompted Moreno’s legal team to seek sanctions, according to a New York Post report.

In February, during an ongoing bitter custody dispute, Miller’s attorney submitted a notarized statement in which Miller claimed his girlfriend was present inside his home during a Feb. 1 custody exchange with Emily Moreno. Moreno has alleged that Miller grabbed her by the arm and shoved her against a wall during that exchange.

“Unbeknownst to [Moreno], my girlfriend, J.A., was present inside my home during the entire custody exchange,” Miller stated, while denying the abuse allegation. He added that his girlfriend provided statements to child services and a private investigator confirming her presence and that she heard no commotion. He also described Moreno’s behavior as “unpredictable, irrational, unhinged, and confrontational.”

Miller further cited Ring doorbell footage, claiming it showed Moreno in a good mood with “no signs of having been the victim of any domestic violence.” During a court hearing, when asked if the footage showed his girlfriend present just before the exchange, Miller reportedly answered “Yes.”

However, nearly two weeks later, Miller’s attorneys emailed Moreno’s legal team admitting: “We learned that [the girlfriend] was in fact not likely present at Max’s home during the time of the child exchange.”

In the footage reviewed by the Post, Moreno is heard saying “bye,” while Miller tells their two-year-old daughter “love you.” Miller’s attorney, Adam Brown, told the Post that the videos were taken immediately after the alleged incident and show Moreno “under no distress whatsoever” and in an “uplifted mood.”

On Monday, Moreno’s attorney, Andrew Zashin, urged Miller’s team to withdraw or revise the protection order request. After they declined, Zashin filed a motion Wednesday seeking sanctions against Miller’s attorneys and payment of Moreno’s legal fees.

In response to the report, Miller said, “This is truly exhausting. I just want what’s best for my daughter. Please stop giving my previously diagnosed bipolar ex-wife so much attention. You all need to move on.”
