The New York Times is facing a lawsuit from President Trump’s Equal Employment Opportunity Commission over allegations that race and gender considerations were used in promotion decisions at the newspaper.

The case centers on claims from a white male employee who alleged he was denied a promotion in 2025 because of diversity-focused hiring practices inside the company.

According to the complaint, leadership candidates who advanced in the hiring process matched racial and gender categories the newspaper allegedly wanted represented in management roles.

Fox News host Will Cain discussed the lawsuit during a segment with Fox News contributor Mary Katherine Ham, focusing both on the allegations themselves and on public reactions to claims of discrimination involving white male employees.

“Headline caught our attention. The white man claiming the New York Times discriminates against white men, an employee at the Times is claiming DEI policies cost him a promotion in 2025, and the Times allegedly broke the story on itself,” Cain said.

Cain also referenced the legal action filed by the Trump administration’s EEOC against the newspaper.

“Now the Trump administration’s Equal Employment Opportunity Commission is suing the paper,” Cain said.

According to Cain, the lawsuit alleges that race and gender goals affected decisions about which candidates moved forward during the hiring process.

“The lawsuit claims the times race and gender goals influences decision not to advance the employee,” Cain said.

“It also claims the final round of candidates match the race and gender the paper wanted more of in leadership, a white female, black male, Asian female and multiracial female.”

The New York Times denied the allegations through a spokesperson, according to Cain, and rejected claims that its hiring decisions were politically or racially motivated.

“But a spokesperson for the times, denies the claims, calling the case politically motivated, and insists its hiring practices are merit based,” Cain said.

Cain also pointed to what he described as broader cultural resistance to claims of discrimination against white men.

“There’s two interesting angles to the story,” Cain said.

“One, that this man is claiming that he was discriminated against because of his race. He wasn’t promoted. Other people were because of their race, and the other is the way it’s being covered.”

Cain then criticized reactions dismissing the employee’s complaint because of his race.

“Like, How dare a white man ever claim he’s been discriminated against? Don’t you know, you can’t discriminate against white men,” Cain said.

Ham responded by arguing that discrimination laws apply equally regardless of race and warned that organizations pursuing diversity goals must still comply with legal standards.

“Yeah, the first thing is, discrimination on the basis of race is bad, and there are precious few situations in which it’s legal and sometimes it’s unconstitutional,” Ham said.

“And so you got to be careful about that.”

Ham said organizations can still pursue diversity goals without abandoning merit-based hiring standards.

“You can increase diversity in other ways, which is the stated goal of the New York Times, and also to do merit based hiring,” Ham said.

She also argued that diversity initiatives inside media and progressive institutions were often openly celebrated, which could create legal complications when discrimination lawsuits are filed.

“But here’s one of the issues for these folks when they go into lawsuits, I think, is that a lot of this in lefty circles and particularly in media progressive, you know, highly educated circles was so lauded, so expected, so understood to be virtuous,” Ham said.

“It’s going to be in writing.”

The lawsuit marks another legal challenge involving diversity, equity, and inclusion policies as the Trump administration continues scrutinizing employment practices at major institutions and corporations.

The New York Times maintains its hiring system is based on merit and has denied wrongdoing connected to the allegations in the EEOC complaint.
