Two weeks ago I wrote about the brewing legal battle taking place between Amnesty International and dozens of groups it had labeled as “anti-rights” in a report it published. One of those organizations targeted by Amnesty was a rape-crisis center for women funded by author J.K Rowling.
Rowling created Beira’s Place after learning that the only crisis center for women in her hometown of Edinburgh, Scotland accepted “trans women” as well. Rowling decided this would not do since it meant traumatized women would be forced to share space with men in drag.
Beira’s Place was only one of many groups labeled “anti-rights” by Amnesty and quite a few of them sent Amnesty legal letters demanding a quick apology and/or a promise to retain documents in expectation of discovery for a forthcoming lawsuit. Beira’s Place joined in with its own letter threatening to sue and Rowling took things up a notch by pointing out that her own JK Rowling Women’s Fund would be happy to fund any lawsuits against Amnesty.

Amnesty pulled down their “report” within 48 hours and initially made some noises about it not meeting their internal standards.
“We regret that this briefing was uploaded to our website without going through the established internal review processes that are in place to ensure consistency, accuracy and alignment with Amnesty International UK’s positions.
“Its use of language does not reflect the position of Amnesty International UK which is why it was promptly removed.
But it wasn’t clear from that statement if the report might reappear at some point, perhaps after being revised in some way. There was an expression of regret, but no apology.
Yesterday, Amnesty buckled at the knees and made a full apology for publishing the report in the first place and promised it will never be republished.
We apologise for the publication of the briefing “A growing threat: the anti-rights movement in the UK.” This document should never have been published, and full responsibility for this error rests with Amnesty International UK.
The briefing was taken down within 48 hours of publication, as soon as management were notified of its existence, was not actively promoted, and will not be republished. We have an ongoing internal investigation into how this briefing came to be published.
Whilst we do not share the views of all these organisations, we recognise the concerns raised by those labelled as “anti-rights” in the document. To be clear: this labelling does not represent our institutional position, and we apologise for its inclusion. In particular, we apologise to Beira’s Place and other groups, which we categorised as gender critical organisations, which we should not have collectively labelled as anti-rights. We have also taken down an earlier more discursive briefing (entitled Like A Snowball) which also referenced a wide range of organisations.
AIUK holds itself to the highest standards of research, evidence and editorial oversight in all its publications. We have concluded that this briefing fell significantly short of those standards. We will commission an independent external review to learn from this moment.
AIUK remains fully committed to defending the human rights, dignity, and equality of all marginalised groups, including women, girls, and members of the trans community.
Does anyone really believe that Amnesty is at a loss for how this was published? I don’t believe that at all. I think they were all in on a report which amounted to a UK version of the Southern Poverty Law Center’s “Hate Watch Map.” Only in this case the threat of multiple lawsuits scared them off.
J.K. Rowling celebrated the win, which happened to appear on her birthday.

However, Beira’s Place put out a statement making clear that this apology did not solve all the problems created by the report.

The permanent removal of both reports is a tacit acceptance that they contained allegations which were false and defamatory of a large number of organisations which it classed as ‘gender critical’. While the apology is welcomed it does not rectify the reputational damage caused to Beira’s Place. In particular the apology fails to recognise that those most severely impacted are the staff who work day in day out to support survivors of sexual violence and the many women who need and use the service.
Although the apology extends to those groups classed as ‘gender critical’ it is noteworthy that many other organisations were wrongly defamed by Amnesty in both reports forsimply upholding the protected belief that sex is real, immutable and important in many areas of life. Those organisations also deserve a written apology.”
If you read between the lines it sounds like Beira’s Place is saying the apology Amnesty offered is a good start but insufficient. Will there be another, more fulsome, apology? We’ll have to wait and see.
Erin Reed, who writes a blog exclusively about trans issues, labeled the apology a dark day for trans rights.
The capitulation of Amnesty International signals a bleak new era for transgender people in the United Kingdom. The country that once ranked first in Europe for LGBTQ+ rights now sits 22nd on the ILGA-Europe Rainbow Map, after 11 consecutive years of decline. Under the Labour government, the rollbacks have only accelerated: bathroom bans, school guidance erasing trans students, a trans youth care bans, and more. Now, major institutions cannot even criticize the groups responsible for this. Meanwhile, transgender people in the United Kingdom are watching groups cow in submission to these threats and are left wondering if there is anyone left they can turn to for help.
It turns out that trans rights don’t survive contact with reality unless they are backed up by legal threats to comply or else. That’s what’s now missing in the UK after the Supreme Court found that the word “women” has an actual meaning that has to do with sex, not self-ID’d gender.
The supreme court ruled that the terms “woman” and “sex” in the Equality Act refer to a biological woman and biological sex. Five judges ruled unanimously that the legal definition of a woman did not include transgender women who hold GRCs.
The 88-page judgment said the law “makes clear that the concept of sex is binary, a person is either a woman or a man”. It added that interpreting “sex” as meaning certificated sex “would cut across the definitions of ‘man’ and ‘woman’ and thus the protected characteristic of sex in an incoherent way”.
The judges added that if “sex” did not only mean biological sex in the 2010 legislation, providers of single-sex spaces including changing rooms, homeless hostels and medical services would face “practical difficulties”.
We really need a similarly broad ruling here, i.e. one that isn’t limited to participation in women’s sports.
