Indiana prosecutors will not file criminal charges in the death of a 75-year-old Tim Hortons customer who suffered a fatal heart failure episode following a violent confrontation with a store manager.

Authorities said the evidence did not support prosecuting any employee involved in the May 13 incident, as reported by The New York Post.

Anita Grayson died after the morning brawl inside a Fort Wayne coffee shop.

Her death prompted an extensive investigation because officials initially could not determine whether the circumstances amounted to an accident, a homicide, or a natural medical event.

Allen County prosecutors announced Friday that no charges would be brought, effectively clearing the workers of criminal wrongdoing.

The decision followed reviews of store video, police recordings, emergency calls, witness statements, medical findings, and the legal protections available to people defending others.

Investigators said Grayson entered the shop shortly after 8 a.m. and confronted a 17-year-old employee over her order.

The exchange escalated quickly enough that a 20-year-old shift manager stepped between Grayson and the teenage worker.

According to investigators, the manager placed her hands on Grayson’s shoulders in an effort to prevent her from reaching the minor employee.

Grayson responded by “forcefully shoved,” then struck the manager on the left side of her nose as the confrontation exploded.

Grayson grabbed the manager’s face, scratched her, knocked away her glasses, and pulled her hair.

The struggle then moved to the floor, where two additional employees attempted to separate the women while the coffee shop descended into chaos.

During the fight, investigators said Grayson pulled out a clump of the manager’s hair.

Video reportedly showed Grayson placing clumps of hair into her bag before she was later discovered unresponsive, turning an ugly dispute over an order into a fatal morning.

Prosecutors concluded that the shift manager was legally defending the teenage employee when she intervened.

They also found that Grayson’s response went beyond what could reasonably be justified after the manager touched her shoulders.

“Grayson’s escalation to striking [the manager] in the face was not a proportionate or justified response to being touched on the shoulders,” investigators said.

“As a matter of law, it is Grayson’s blow, not [the manager’s] earlier contact that started the altercation.”

The manager’s actions “did not exceed what the ongoing struggle reasonably called for,” investigators said.

They added that her “initial intervention is independently justified as defense of a third person,” a key finding that shut down the prospect of criminal charges.

“She said she thought Grayson was going to attack the minor employee, so she stepped in.

Under Indiana law, the State cannot proceed unless it can disprove legal justification beyond a reasonable doubt, and on this record it cannot. The current conclusion is that no criminal charges will be filed.”

Allen County coroners previously classified Grayson’s manner of death as undetermined.

E. Jon Brandenberger said the medical cause was an “acute exacerbation of congestive heart failure in the setting of physical altercation,” linking the deadly episode to the stress of the struggle without declaring the death a homicide.

“The symptoms of congestive heart failure get worse when there is adrenaline flowing in a physical altercation, and then a sudden flare-up of the heart failure, which then can lead to symptoms, or hospitalization, and even death,” the coroner said.

Investigators found no major injuries that independently caused her death.

Coroners also declined to classify the death as accidental or natural because of the circumstances surrounding the fight.

Investigators rejected a homicide finding after reviewing the evidence and determining that Grayson had not suffered any “significant contributory injuries” during the confrontation.

“There has been exhaustive investigation and review in the evidence of this case,” Brandenberger said.

“The video was reviewed multiple times by the homicide detectives, by my staff, by the prosecutor, and by the forensic pathologist. Bodycam videos were reviewed. We listened to and transcribed the four 911 calls and multiple meetings.”

“After exhaustive review, we could not determine with reasonable certainty that Mrs. Grayson’s death was either natural, or homicide, or accident. Therefore, the manner of death that is appropriate to use is undetermined, meaning could not be determined.”

Grayson, a mother of four, is now at the center of possible civil litigation despite prosecutors declining to pursue a criminal case.

Her family retained civil rights attorney Ben Crump, while daughter Tawnda Grayson described her mother as hardworking, compassionate, selfless, and always willing to put others first.
