Federal authorities have made arrests in a string of election-related cases involving noncitizens, creating an inconvenient collision with Democratic claims that such voting is either extremely rare or simply nonexistent, as reported by Fox News.
The cases have emerged amid the partisan battle over the SAVE Act, which would require proof of citizenship for registration in federal elections.
Democrats contend the requirement would make voting more difficult for eligible Americans.
Congressman Chip Roy stressed the urgency of passing the measure and pointed to what was described as a software glitch in New Jersey.

According to Roy, 6,600 noncitizens were registered to vote, and hundreds ultimately voted.
Roy said the situation demonstrated the need for voter identification requirements, which the source reported are supported by 80% of Americans. He urged the Senate to approve the legislation.
Pennsylvania Democratic Rep. Mary Gay Scanlon offered a far more dismissive assessment in 2025 after voting against the bill.

“Let me be perfectly clear: This is a non-issue. Noncitizens do not vote in U.S. elections,” Scanlon declared.
Three noncitizens were arrested this month in Philadelphia County, part of which Scanlon represents, and charged with election-related offenses.
Fox News Digital contacted Scanlon for comment.
Trinidad and Tobago national Sade Guppy allegedly voted illegally in the 2022 midterms.
Haitian illegal immigrant Cliff Sanon was charged with submitting a fraudulent voter registration application before the 2026 Pennsylvania primary.
The Department of Homeland Security also directed Fox News Digital to the case of Mauritanian illegal immigrant Mahady Sacko. Sacko is accused of voting in seven federal elections since 2008.
Attorney General Todd Blanche announced Wednesday that 10 foreign nationals had been indicted on accusations of committing voter fraud in Minnesota, including during the August primary.
Blanche said the matter should not be a “partisan concept.”
The alleged illegal voters were identified as people from Brazil, Ghana, Germany, Bosnia-Herzegovina, Liberia and Canada.
The announcement added another batch of cases to the growing dispute over whether noncitizen voting warrants further federal action.
California Democratic Sen. Alex Padilla has called noncitizen voting “extremely rare” while attacking the SAVE Act as “anti-voter.”
He has also accused President Donald Trump of attempting to “scapegoat immigrants.”
Asked Wednesday about the arrests, Padilla said the conduct is “already illegal, and every legitimate study shows it is extremely rare, despite Donald Trump’s claim to the contrary.”
He argued that the Justice Department’s arrests after investigating millions among 174 million registered voters confirmed his position.
Padilla also said he wanted the Justice Department to focus instead on reported delays in voter registration processing in states such as Texas.
He called the announcement of 12 arrests a “desperate attempt by Republicans to distract from their record of rising costs, chaos, and corruption that are hurting the American people.”
New York Democratic Rep. Joe Morelle has described the SAVE Act as “extremely dangerous” and “voter suppression.”
His office responded to Fox News Digital but did not provide a comment before publication.
Virginia Democratic Rep. James Walkinshaw made a similar argument last month on MSNOW.
“It is so rare that is almost impossible to measure. It just doesn’t happen,” Walkinshaw said while accusing Trump of reviving the “Big Lie” and complaining about losing the 2020 election.
Fox News Digital also requested comment from Walkinshaw and Vermont independent Sen. Bernie Sanders. Sanders said in March that “noncitizens do not vote in American elections.”
New Jersey Gov. Mikie Sherrill disclosed over the summer that roughly 400 noncitizens had voted in the state while resisting demands for additional federal scrutiny.
Three New Jersey residents from Jamaica, Venezuela and Senegal were also charged this month with illegally voting and making false statements on citizenship applications.
A Department of Homeland Security spokesperson said the agency could not discuss active investigations but remained committed to “rooting out and investigating election fraud wherever it can be found.”
White House spokesperson Lauren Bis said, “Despite the media and Democrats denying it for decades, noncitizens continue to register and vote in federal elections.”
“Only Americans should be electing America’s leaders,” Bis added. The arrests and competing claims are sharpening the dispute as both sides intensify their arguments ahead of key midterm elections.
