The Cornell rape investigation was already facing intense scrutiny, but New York Gov. Kathy Hochul’s decision to appoint Attorney General Letitia James as special prosecutor has poured gasoline on the controversy. The appointment immediately raised questions about whether James can approach the case impartially.

The criticism centers on James’s partisan reputation and a Facebook post she published about the woman making the allegations. The post appeared to accept the woman’s account before James had conducted her own investigation.

The case involves an alleged gang rape in 2024. Jane Doe has accused several Cornell fraternity members, while questions remain about consent, the timing of the alleged incident, and the role of drugs and alcohol.

Those unresolved issues demand a careful review of evidence rather than a public rush to judgment. Instead, James entered the spotlight carrying her own public statement about the accuser and the allegations.

That statement became the focus when a reporter confronted James and Hochul. The reporter asked why James had appeared to affirm the allegations as fact and why Hochul selected someone who had already commented publicly on the matter.

The question quoted James’s Facebook message, which described what the young woman endured as horrific and unacceptable. It also offered support to her and to “all survivors,” language that prompted concerns about whether James had reached a conclusion prematurely.

The reporter asked: “Attorney General, on your Facebook page three days ago, you wrote, ‘What this young woman has been forced to endure is horrific and unacceptable. I’m holding her in my heart and in my prayers. To her and to all survivors, you’re not alone. We stand with you.’ Why did you affirm her allegations as fact without doing your own fact-finding investigation? And to the governor, why did you appoint an official who made a public statement affirming those allegations as fact as someone who’s supposed to be doing an investigation?”

Hochul stepped in before James answered. The governor expressed confidence that James would examine the case properly despite the concerns raised about her Facebook statement.

Hochul said: “I will answer that. I have every confidence in our Attorney General to do what she has always done. Look at the facts, examine the record, and draw the proper conclusions. That’s exactly what’s going to happen in this case. Attorney General, please.”

When Hochul handed the moment to James, the attorney general declined to address the substance of the question. Her response was brief and offered no explanation of how her public comments fit with her new investigative role.

James said: “I will not comment on a Facebook post.”

That refusal only sharpened the criticism surrounding her appointment. The post was written by James herself, and the reporter’s question directly concerned whether those words indicated that she had already accepted the allegations before reviewing the evidence.

Hochul’s choice is another step toward turning the investigation into a political circus. It also argues that activists are moving to condemn the accused before investigators have reached evidentiary conclusions.

The commentary connects that rush to judgment with the collapse of the “Believe All Women” slogan during the Me Too movement. It argues that accusations involving liberal men and Democratic politicians exposed selective standards among activists and political allies.

At the same time, the Cornell allegations contain numerous details requiring analysis. Questions about consent, timing, drugs, alcohol, and the competing descriptions of what occurred cannot be resolved through slogans or Facebook declarations.

There is the possibility that regrettable sex is now being characterized as rape, while emphasizing that such a possibility must be weighed against the allegations and evidence. That is precisely why James’s earlier statement has become so central to the dispute over her impartiality.

James now holds the special prosecutor role while refusing to explain a post that appeared to place her squarely on one side of the controversy. Hochul insists James will look at the facts and draw proper conclusions, but James’s curt answer did nothing to quiet the questions.
