Pam Bondi is out as Attorney General, and Assistant AG Harmeet Dhillon is allegedly set to receive a promotion to Associate AG; the third highest ranking official in the Department of Justice. If that happens, the Civil Rights Division will need a new chief, and there’s no guarantee that it will be someone as intent on using the division to challenge state and local gun control laws as Dhillon has been. 





My nightmare scenario: Trump names current U.S. Attorney for Washington, D.C Jeanine Pirro as Dhillon’s replacement… or worse, as his next Attorney General. 

Pirro has already drawn the ire of Second Amendment groups for declaring anyone bringing a gun into the District is going to jail, even if the have a valid carry permit from their home state. And though she has taken a few positive steps like refusing to prosecute those accused of violating the District’s ban on “large capacity” magazines, her office is now encouraging the D.C. Court of Appeal to re-hear a case where that ban was held to be unconstitutional. 

In a deeply frustrating development, the United States’ DC office argues that Benson should be granted en banc review, even though it is not defending the magazine capacity law any more.

And, they are mad that other parts of the conviction were struck down.

In addition to claiming the court needs to re-hear the case in order to “maintain uniformity” with other decisions and to answer a question of “exceptional importance” (that was already answered quite well by the three judge panel that threw out the law, thank you very much), Pirro’s filing actually defends the District’s laws prohibiting the carrying of a firearm without a license, possession of an unregistered handgun, and unlawful possession of ammunition. 





There are no “public safety concerns.” Most states do not require per-firearm registration and are much safer than DC.

To risk losing a circuit split on the magazine question to save an (unconstitutional) registration scheme is insanity.

A bad decision reversing the panel’s ruling wouldn’t technically risk losing a circuit split because the D.C. Court of Appeals is a local, not a federal court. But because it is the highest court in D.C.’s municipal government, rulings there tend to have more of an impact than other local courts. Benson has already drawn the interest of national gun control groups and anti-gun AGs, who’ve also demanded an en banc review. Now we have the U.S Attorney’s office essentially taking their side, even if it means the court upholds the magazine ban that Pirro’s been refusing to enforce.

I haven’t heard Pirro’s name mentioned as a potential replacement for Dhillon at the Civil Rights Division, but he Reload’s Stephen Gutowski mentioned that Pirro’s name has come up as the next Attorney General. 





If I had my way, Pirro would get the boot altogether. Her pro-2A moves have been limited at best, and they’ve been undercut by other actions and statements that she’s made, including this brief inviting the D.C. Court of Appeals to uphold the District’s ban on “large capacity” magazines. If anyone in Trump’s inner circle is reading this, please whisper in the president’s ear that Pirro really needs to return to Fox News where she can be most helpful to his administration instead of remaining in her current position or, God forbid, getting promoted.
