The Oversight Project has uncovered new evidence that raises serious questions about Joe Biden’s use of the presidential autopen during his time in office, suggesting key decisions may have been signed off without his direct involvement—even while he was physically present in the capital.
According to documentation obtained by the watchdog group, dozens of official actions—including executive orders, pardons, and commutations—were signed by autopen while Biden was reportedly available to sign them himself.
The investigation shows that Biden used the autopen to authorize 32 out of 51 clemency warrants despite being in Washington, D.C. at the time.
Two-thirds of autopenned pardons—including ones for the members of the January 6 Committee, President Biden’s family members, Dr. Anthony Fauci, General Mark Milley, Iranian spies, and others—occurred when President Biden was physically located in Washington, D.C.

The report also reveals that on at least eight occasions, Biden hand-signed legislation the same day that executive orders were autopened.

The autopen, a mechanical device that reproduces the president’s signature, has been in use since the 1950s, though rarely employed for critical government documents due to constitutional concerns.
Its first high-profile use for legislation occurred in 2013 when President Barack Obama, while vacationing in Hawaii, authorized its use to sign a bill during his absence from Washington.
Under Biden, however, the Oversight Project reports that the device was used in a significantly different manner: signing critical presidential orders even when Biden was in the capital and personally signing other documents.
The irregularity has sparked renewed scrutiny, with questions mounting about who was responsible for authorizing these signatures and whether Biden was fully aware of the actions taken in his name.
The watchdog group’s investigation also identified a troubling pattern in the use of autopen for clemency decisions.
Among the actions signed without Biden’s physical signature were commutations for nearly every inmate on federal death row, clemency for Iranian nationals accused of espionage, and pardons for high-profile figures including members of the January 6 Committee, Anthony Fauci, and General Mark Milley.
Only six pardons were issued by autopen while Biden was out of Washington, during a family trip to St. Croix in the U.S. Virgin Islands. All other documented instances occurred while he was reportedly in the capital.
In fact, the only autopenned pardons that were issued when President Biden was not in Washington, D.C., were the six pardons issued while President Biden was golfing with his family on St. Croix, U.S. Virgin Islands.

President Donald Trump responded to the findings on Wednesday, calling for a full investigation and accusing Biden’s aides of orchestrating a cover-up.
“It has become increasingly apparent,” Trump said in a statement, “that former President Biden’s aides abused the power of Presidential signatures… to conceal Biden’s cognitive decline and assert Article II authority.”
Trump highlighted that more than 1,200 presidential documents, 235 judicial appointments, and 37 pardons for death row inmates were authorized during Biden’s term, many without Biden’s direct signature.

Biden issued a statement defending his use of the autopen, saying, “I made the decisions during my presidency,” and dismissed the investigation as a political attack.
However, The Oversight Project argues that the timeline and documentation suggest otherwise.
The issue has prompted calls from Republican lawmakers for congressional hearings.
Oversight leaders are reportedly preparing subpoenas for White House staff involved in processing and authorizing presidential documents during Biden’s administration.
The investigation remains ongoing.
