Cape Coral City Councilmember Rachel Kaduk was arrested last Tuesday night after a witness reported that she had been driving recklessly for approximately 20 minutes while traveling home from Oak and Stone, nearly colliding with several vehicles along the way.

According to police, the witness followed Kaduk’s vehicle and contacted authorities, reporting erratic driving behavior that included almost striking multiple cars.

Officers later located Kaduk and initiated a traffic stop near her home.

Body camera footage from the encounter shows officers asking Kaduk to participate in field sobriety exercises.

At first, she declined.

“I’m just shaking my head no because it is ridiculous,” Kaduk said.

After the initial refusal, Kaduk agreed to proceed with the tests. Officers began with a horizontal gaze nystagmus test, commonly known as an eye exam, in which a subject is asked to follow a pen or object with their eyes.

An officer explained the importance of the evaluation and attempted to clarify the instructions.

“I’m trying to give you an opportunity, so follow the tip of my pen with your eyes or your eyes or to understand,” the officer said.

Kaduk responded that she understood but appeared confused during the process.

“Follow the path. Do you understand? Are you unable to?” the officer asked.

“I don’t know what you’re asking,” Kaduk replied.

She then proceeded to the nine-step walk-and-turn test.

Video footage shows Kaduk completing portions of the exercise but stopping before finishing the final evaluation. During the interaction, she referenced her proximity to her home.

“I’m almost there. I’m very close to home,” Kaduk said.

Throughout the stop, Kaduk mentioned her role as a city council member and her personal ties to the area.

“Well, I’m from Cape Coral. I grew up in this exact same district that I’m representing, right?” she said.

As the encounter continued, officers questioned Kaduk about her intentions at the scene. She responded by asserting that she planned to leave.

“I am actually leaving because you have found nothing here,” Kaduk said.

Officers then informed her that she was being placed under arrest and applied handcuffs. After being detained, Kaduk asked to make a phone call, stating that she needed to contact her 15-year-old daughter.

“Call her,” an officer replied.

“Let her know that you’re going to be in jail for the night, OK?”

“I shouldn’t be in jail for the night because I shouldn’t be doing this,” Kaduk said.

Police also asked Kaduk to submit to a breathalyzer test.

She requested to speak with her husband and later declined to answer additional questions.

Court records show that Kaduk has waived her arraignment and entered a plea of not guilty in the case.

Records also indicate that this is not her first encounter with law enforcement related to driving behavior.

In 2013, Kaduk pleaded no contest to a reckless driving charge.

The arrest has drawn attention in Cape Coral, where Kaduk serves as an elected official representing a district she has said she grew up in and continues to reside in.
