Senate Majority Leader Chuck Schumer (D-NY) is blocking Senator-elect Dave McCormick (R-PA) from attending next week’s Senate orientation for incoming members.
McCormick defeated incumbent Senator Bob Casey (D-PA) in the recent election, a result confirmed by the Associated Press and numerous other media outlets.

However, Casey has not conceded, as Democrat election attorneys, led by Marc Elias, are attempting to overturn the results through a challenge involving uncounted provisional ballots.
Schumer has cited Casey’s refusal to concede as the basis for denying McCormick access to the orientation, despite the fact that McCormick’s win has been widely called.
Casey would need an overwhelming share of the remaining provisional ballots to shift the outcome, a scenario considered highly improbable based on current counts.
A piece of data on why Casey’s hopes on provisionals are crazy. Wayne County completed provisionals. McCormick +51%. In 2022 it was Fetterman +30%. That’s an R+81 swing in the provisionals. The votes for Casey to win are just not there.

While Schumer has barred McCormick, he has not applied the same standard to Senator-elect Ruben Gallego (D-AZ), whose race was called in his favor despite Republican challenger Kari Lake’s refusal to concede.
The petty vindictiveness of the elitist Schumer is not surprising, however Gallego should then not be allowed to attend as well.

This inconsistency has drawn sharp criticism from Senate Republicans, who argue that Schumer’s actions reflect a double standard.
Several GOP senators took to social media to express their frustration. Senator Marco Rubio (R-FL) wrote on X (formerly Twitter), “Schumer is not allowing @DaveMcCormickPA to participate in Senate orientation this week because Casey refuses to concede the race. What happened to all the demands that our leaders accept the outcome of the elections?”

Senator Rick Scott (R-FL) echoed Rubio’s sentiments, describing Schumer’s decision as “disgusting.”
In an X post, Scott noted, “Dave McCormick is the senator-elect & @SenSchumer’s move to not allow him to participate in orientation this week is disgusting. They did the same thing to me after I beat a Democrat in 2018. We have to fight this!” Scott called on Casey to concede, declaring, “AP called it. Dave won, Casey must concede NOW.”

Senator Mike Lee (R-UT) announced his intention to defy Schumer’s order by personally escorting McCormick into the orientation. “I’m willing to personally escort @DaveMcCormickPA into the Capitol for new-senator orientation,” Lee wrote. “I’d like to see how they’d keep him out if he literally walked into ‘the room where it happens.’”

The ongoing dispute has added tension to the post-election period, with McCormick and his team asserting their right to begin preparing for the upcoming term.
Schumer’s refusal to grant McCormick access highlights a rare procedural roadblock in the Senate’s traditional welcome to new members, particularly given that McCormick’s victory has been acknowledged by major news organizations.
Casey’s legal team, led by Elias, maintains that the election outcome could still be altered depending on provisional ballots.
However, analysts have stated that Casey would need to secure an unprecedented majority of these ballots to overturn the current results, a prospect that remains statistically unlikely.
The situation bears similarities to Scott’s own experience in 2018 when he faced delayed recognition as Florida’s Senator-elect amid challenges from the Democratic incumbent.
With the Senate split over the results and orientation procedures, the dispute may continue until the formal seating of the new Congress, pending further legal developments in Pennsylvania.
McCormick’s absence from orientation could potentially delay his Senate preparedness, though his supporters argue that he should be allowed to participate regardless of Casey’s decision to concede.
The upcoming orientation is a customary period for new senators to meet colleagues, familiarize themselves with Senate protocol, and prepare for their official duties in January.
