Daniel Penny Didn't Know Neely Was Dead When NYPD Interviewed Him

There was an interesting twist in the ongoing martyrdom of Daniel Penny in a New York City courtroom yesterday.

I find it to be just one more disgusting plop of steaming cow poo comprising the patty that is the disreputable, racist, and overtly politicized District Attorney’s office in Manhattan ably assisted by their Renfields in the NYPD.

During the proceedings yesterday, a video of Penny’s initial interview with detectives was played for the first time. It is quite apparent that no one has informed the former active duty Marine that the fellow he had restrained in an effort to protect fellow passengers – Jordan Neely – had died after the incident.

Daniel Penny appeared unaware that his chokehold on Jordan Neely had killed the homeless man — and tried to downplay the maneuver hours later, insisting he wasn’t “trying to kill the guy,” it was revealed in court Thursday.

“I wasn’t trying to injure him. I’m just trying to keep him from hurting anybody else,” the Marine veteran, 26, told two detectives during a videotaped interrogation shown to jurors.

“That’s what we are taught in the Marine Corps,” Penny added, referring to protecting others, in the footage played during the third week of his lightning-rod manslaughter trial in Manhattan Supreme Court.

Detective Brian McCarthy testified that he did not tell Penny that Neely had died during the interrogation — though video of the subway car shows that Penny witnessed police officers trying to revive a lifeless Neely minutes after the chokehold ended.

Investigators with the Manhattan District Attorney’s Office were also, unbeknownst to Penny, watching him through a one-sided mirror at Chinatown’s 5th Precinct, McCarthy said.

And I do take issue with the first sentence of the NY Post report – it’s a matter of significant dispute if Penny’s chokehold killed Neely, considering the man’s chest is clearly rising and falling in every video of the incident itself, and Neely had a faint pulse when officers arrived. The police sergeant at the incident scene ordered Narcan…

…Bodycam of NYPD Sgt. Carl Johnson showed officers from a different angle giving Neely chest compressions before EMS workers arrived.

Johnson told the court he ordered Narcan during the chaotic scene, claiming that Neely was an “apparent drug user and he was very dirty.”

…all things considered, a totally reasonable reaction – and then EMTs administered CPR (The NYPD Sgt testified due to potential diseases, they did not do so) instead of addressing Neely’s breathing issue first.

The Post editorial board called out the never-before-seen video of the frantic resuscitation attempt when it first aired at the trial themselves.

Turns out subway madman Jordan Neely was alive after Daniel Penny released his chokehold — why on earth is the broader public just learning this now?

Bombshell video played in the opening days of Penny’s trial (already being protested by BLM lunatics) shows two of the cops who arrived on the scene confirming that Neely still has a pulse.

Penny has been portrayed by leftist activists and their media allies as a cold-blooded racist killer.

Yesterday’s testimony also included an appearance by the martial arts instructor who had initially taught Penny the ‘less than lethal’ chokehold version while in the Marines. He testified Penny used an “improper version” of the maneuver, which is the news getting all the airtime in this morning’s press.

The prosecutors are accusing Penny of holding on for 51 seconds too long.

Of course, what’s being left off of the blaring Leftist media headlines was what the martial arts expert had to say when questioned by Penny’s lawyers on their cross.

And why?

Because while what Daniel Penny utilized might have been “improper” form, the expert prosecution witness saw nothing lethal.

In point of fact, he notes repeated restraint in the use of force on Penny’s part.

…Under cross-examination from defense attorney Steven Raiser, Caballer said he agreed that someone could be placed in a chokehold for more than 13 seconds and not lose consciousness if the person performing the hold wasn’t applying pressure. He also said that while Marines are told not to apply a choke for longer than 5 seconds in training, that doesn’t apply to the real world.

“Is there any point Mr. Penny appears to be applying a blood choke fully for Mr. Neely to go unconscious?” Raiser asked while showing images from eyewitness video.

“Not from what I can see,” Caballer replied.

And what about that “additional 51 seconds”? Didn’t Penny have an obligation to turn Neely loose then?

Well…HUH.

…When asked if there’s any reason why the hold should be released completely before Penny was 100% convinced that Neely was no longer a threat, Caballer said the decision would be up to Penny’s judgment.

“If you release the hold too soon, there could be struggling, fighting,” he said.

After the video played again, Caballer said that at the start, Penny did not appear to be applying as much pressure as he was at the 1 minute, 43 second mark, when Neely started struggling, and then he relaxed his grip again.

So the prosecution expert, reconsidering the video evidence, says Daniel Penny adjusted his non-lethal hold according to Jordan Neely’s actions and, when less force was required to control Neely, used no more pressure – indeed, relaxied his grip.

None of that made any of the first paragraphs in the stories.

I’d say, “It makes you wonder,” but there’s no wonder about it.

…In January, New York magazine ran a soft-focus cover story, headlined: ‘Finding Jordan Neely’.

It was a love letter to an urban menace, with writer Lisa Miller musing that Neely’s threats to terrified passengers that day were ‘perhaps a plea to be back in a place where meals and medications were provided, perhaps a sign of his exhaustion or anguish, perhaps an admission of defeat’.

…Naturally, Al Sharpton, New York City’s original race-baiter, eulogized Neely.

‘We can’t live in a city,’ Sharpton said, ‘where you can choke me to death with no provocation, no weapon, no threat.’

…But for Sharpton and compatriot Alexandria Ocasio-Cortez, who positioned herself front row at Neely’s funeral, violent crime is so often adjudged solely through race.

‘Jordan Neely was murdered,’ AOC posted on X, two days after his death. ‘The murderer gets protected [with] passive headlines [and] no charges. It’s disgusting.’

We knew exactly where this was headed – and WHY – from the minute Alvin Bragg had Daniel Penny arrested eleven days after the tragic encounter.
