Supreme Court Justice Ketanji Brown Jackson is facing renewed criticism following comments she made during a Q&A at an Indianapolis Bar Association event, where she cited “the state of our democracy” as the issue that keeps her up at night.

The event, held Thursday in Indianapolis, featured Jackson answering a series of lighthearted, quickfire questions about her personal preferences, including favorite books and music. However, when asked what causes her sleepless nights, the tone shifted.

“I would say the state of our democracy,” said Jackson, 54, drawing applause from the audience.

She continued, “I’m really very interested in getting people to focus and to invest and to pay attention to what is happening in our country and in our government.”

The justice did not elaborate further on her remarks or provide specific concerns behind her statement.

Critics quickly seized on the comments. Among the backlash, some X users questioned Jackson’s qualifications and impartiality.

“What keeps me up [at] night is knowing that we have unqualified Justices like Jackson on the SCOTUS,” one post read.

Another user wrote, “Having someone like her on the Supreme Court is what keeps me up at night.”

Several critics suggested Jackson’s comments highlighted a tendency to base legal interpretations on emotion rather than legal principle.

One user noted, “She is informed in her opinions by her emotions rather than the rule of law.”

Another added, “Her unprofessionalism is an embarrassment to the bench.”

Another user stated, “She’s functionally an activist, not a judge. Impartial judges committed to faithful application of the law don’t make incendiary comments like this in public.”

Some pointed to Jackson’s recent dissents as evidence of judicial activism.

“Some of her dissents this term have been pretty embarrassing,” one post stated, adding that some “sound like a substack post” instead of a formal legal opinion.

Justice Jackson was the lone dissenting voice in an 8-1 Supreme Court ruling earlier this week that allowed President Trump to move forward with his initiative to restructure the federal workforce.

The majority opinion opened the door for more streamlined firings of federal employees.

Last month, Jackson also drew widespread criticism for her dissent in a major birthright citizenship ruling.

In her opinion, Jackson warned that “our beloved constitutional Republic will be no more” if the majority ruling were to stand.

In a pointed rebuttal, Justice Amy Coney Barrett directly addressed Jackson’s position.

“We will not dwell on Justice Jackson’s argument, which is at odds with more than two centuries’ worth of precedent, not to mention the Constitution itself,” Barrett wrote.

Barrett added, “We observe only this: Justice Jackson decries an imperial Executive while embracing an imperial Judiciary.”

Justice Jackson was appointed to the Supreme Court by Joe Biden and has served on the bench since 2022.

Throughout her tenure, she has often been the court’s most frequent dissenter and has received strong criticism from legal commentators across the ideological spectrum, including from within the liberal legal community.

The Indianapolis event marked a rare public appearance where Jackson spoke outside of formal court settings.

While her comments may have drawn applause from attendees, they have reignited debate over her role on the court and the line between judicial conduct and political rhetoric.
