A heated exchange unfolded on Capitol Hill Wednesday as Rep. Marjorie Taylor Greene (R-GA) presented evidence during a House Homeland Security Committee hearing that identified Kilmar Abrego Garcia as a verified member of the MS-13 gang.

The claim prompted a sharp objection from Rep. Dan Goldman (D-NY), who accused Greene of misstating facts and objected to her submission of documents into the official record.

Greene cited multiple sources, including immigration judges, ICE officers, and law enforcement, asserting that Garcia, an illegal immigrant from El Salvador, had long been verified as a member of MS-13.

“A Maryland County Police gang unit agreed that [Garcia] is MS-13, a reliable confidential informant agreed that he’s MS-13, ICE officers agreed that he’s MS-13, an immigration judge agreed that he is MS-13, an appellate board agreed that Kilmar Abrego Garcia, your Maryland man, is MS-13,” Greene said during the hearing.

Goldman immediately objected. “I object because she is misstating the record and the facts,” he said.

“That is not accurate and therefore I object to that being introduced … There is no final court order establishing that he’s a member. Maybe he is, so you should put all that evidence before a judge and if he’s MS-13, he should be deported. That’s what we’re talking about, but you’re misstating what all of that evidence is.”

Committee Chairman Rep. Mark Green (R-TN) overruled the objection, affirming that Greene had the right to submit the documents into the congressional record.

Garcia, who illegally entered the United States in 2011, was first detained in March 2019 after being found loitering in a Home Depot parking lot in Maryland.

According to Department of Justice documents released on April 16, Garcia was wearing clothing commonly associated with MS-13 gang symbolism, including a hoodie and a Chicago Bulls cap that authorities stated reflected “good standing” within the gang.

Later that year, in December 2019, the Board of Immigration Appeals upheld an immigration judge’s determination that Garcia was “a verified member of MS-13.”

The judge ordered his removal from the United States, but Garcia received a withholding of removal based on a ruling that his life would be in danger if he returned to El Salvador.

In 2022, Garcia was pulled over by authorities on a Tennessee highway while transporting eight passengers with no luggage, raising suspicions of human smuggling.

The vehicle was registered to Jose Ramon Hernandez-Reyes, an illegal immigrant convicted of human smuggling in 2020.

Garcia’s wife, Jennifer Vasquez Sura, filed a domestic violence restraining order against him in 2021.

According to Department of Homeland Security records, she accused him of physically assaulting her and destroying her personal property during an altercation.

Despite Garcia’s background and gang ties, several Democratic lawmakers, including Sen. Chris Van Hollen (D-MD), traveled to El Salvador in recent years to advocate on his behalf.

The Trump administration had previously stated that although Garcia’s deportation was initially ruled improper by the courts, he should not return to the U.S. due to his criminal record and gang affiliations.

While the U.S. Supreme Court ruled that the administration must “facilitate” Garcia’s return, El Salvadoran President Nayib Bukele has stated that his government will not send Garcia back to the United States.

Bukele made the declaration during an April 14 meeting, citing Garcia’s criminal ties and gang activity as grounds for refusal.

The debate over Garcia’s status, criminal record, and gang affiliations remains ongoing, as House Republicans continue to scrutinize immigration enforcement policies and Democratic lawmakers’ advocacy efforts for individuals with suspected criminal backgrounds.
