Democrat U.S. Representative LaMonica McIver has been indicted by a federal grand jury on three criminal counts related to an incident involving federal law enforcement officers at the Delaney Hall detention center in Newark, New Jersey, last month.
The indictment, returned in federal court, charges McIver with forcibly impeding, assaulting, and interfering with federal officers, according to an announcement by U.S. Attorney Alina Habba.
The charges stem from McIver’s alleged verbal abuse and physical altercation with Immigration and Customs Enforcement (ICE) agents during the course of their duties at the federal detention facility.

The three-count indictment includes:
- Count One: Forcibly impeding federal law enforcement officers, carrying a maximum penalty of eight years in prison.
- Count Two: Interfering with federal law enforcement officers, also carrying a maximum penalty of eight years.
- Count Three: A separate count with a maximum penalty of one year.
If convicted on all counts, McIver could face up to 17 years in federal prison.
“Today a federal grand jury seated in Newark, New Jersey returned a three-count indictment charging U.S. Representative LaMonica McIver with forcibly impeding and interfering with federal law enforcement officers,” U.S. Attorney Habba said in a statement.
“This indictment has a maximum penalty of 8 years for Count One, an additional maximum penalty of 8 years for Count Two, and a maximum penalty of 1 year in prison for Count Three.”

U.S. Attorney Habba emphasized the seriousness of the charges and the importance of protecting federal agents in the line of duty.
“As I have stated in the past, it is my Constitutional obligation as the Chief Federal Law Enforcement Officer for New Jersey to ensure that our federal partners are protected when executing their duties,” Habba stated.
“While people are free to express their views for or against particular policies, they must not do so in a manner that endangers law enforcement and the communities those officers serve. Today’s decision by the grand jury is the next step in a process that my Office will pursue to a just end.”

McIver was previously charged with violating Title 18, United States Code, Section 111(a)(1), which criminalizes assaulting, impeding, or interfering with federal officers.
“Today my office has charged Congresswoman McIver with violation of Title 18, United States Code, Section 111(a)(1) for assaulting, impeding and interfering with law enforcement,” Habba said when the charges were first announced.

Body-worn camera footage from ICE agents reportedly captured McIver threatening the officers and making profane statements during the altercation.
According to that footage, McIver shouted, “I touch whoever I want motherf**ker!” as she physically confronted ICE agents. The complaint alleges she also threatened to ruin their careers.

Following her initial court appearance last month, a judge ordered McIver to surrender all firearms and prohibited her from traveling outside of the United States.
Rep. McIver has since released a statement in response to the indictment. The content of her statement has not yet been publicly released in full.
As the legal process continues, federal authorities have not indicated whether additional charges may be filed. McIver remains in office while the proceedings unfold.
No further court dates have been announced at this time.
