Department of Homeland Security (DHS) Secretary Kristi Noem has announced the enforcement of the Alien Registration Act, a law originally passed in 1940 that requires individuals entering the U.S. illegally to register with the federal government within 30 days.
The move aligns with President Donald Trump’s commitment to strengthening immigration enforcement and ensuring compliance with existing laws.
Speaking with Fox News’ Jesse Watters Primetime, Noem outlined how the law will be enforced and its implications for illegal immigrants currently in the country.

“Well, we are putting in place and enforcing the Alien Registration Act, which is using every single tool that we have at our disposal to do exactly what President Trump promised the American people,” Noem said.
The Alien Registration Act mandates that individuals present in the U.S. illegally must register within 30 days, undergo fingerprinting, and officially announce their presence.
Those who comply can avoid criminal charges and fines while receiving assistance in returning to their home country.
According to Noem, this process provides an opportunity for them to re-enter the U.S. legally in the future.

“If they do so, they can avoid criminal charges and fines, and we will help them relocate right back to their home country,” Noem explained.
“And what this does is provide them an opportunity to come back someday and to be a part of the American dream. If they don’t register, they’re breaking the federal law, which has always been in place. We’re just going to start enforcing it to make sure that these aliens go back home and when they want to be an American, then they can come and visit us again.”
Watters highlighted the law’s long-standing existence, noting that it was signed into law by Democratic President Franklin D. Roosevelt in 1940.
“All right, so this act, I mean, this is from 1940. This is Roosevelt. This is signed into law by a Democrat president and has been on the books. I mean, that’s what they’re supposed to be doing. Now we’re saying they’re supposed to have registered with the federal government. Where are they supposed to be registering?” Watters asked.
Noem confirmed that the DHS has launched an online registration system to facilitate compliance.
“We have a website that is live now. It’s at USCIS forward slash alien registration. You can go there now. And these folks that are here in this country illegally can self-register, they can avoid the criminal charges, they can avoid the fines, and we will help them go home.”
She emphasized that enforcing the law enhances national security, reduces financial burdens on taxpayers, and creates a safer environment for American communities.
“And what that provides for them is a safer environment. It’s safer for our communities. It saves us taxpayer dollars, and it allows them an opportunity to come back to this country and to be an American and to live the American Dream, which is truly what our history is all about.”
The announcement marks a significant shift in immigration enforcement, as previous administrations largely neglected this provision of the law.
Under Noem’s leadership, the DHS is taking a proactive stance to ensure compliance with immigration laws and facilitate the return of illegal immigrants to their home countries.
“So yes, Jesse, this is not a new law. I’m just announcing that I’m going to enforce our law, and we’re going to use this tool to make sure that we’re following our law to provide people an opportunity to go home and come back and be a part of our country’s future in the right way,” Noem concluded.
