Special Counsel Jack Smith, known for his relentless pursuit of former President Donald Trump in high-profile cases, reportedly plans to resign before Trump’s upcoming inauguration.

As reported by The Daily Mail, sources close to Smith shared that he intends to conclude his investigations to avoid a potential dismissal by Trump, who famously said he’d fire Smith “within two seconds” if elected.

Smith has overseen two major cases against Trump: one involving classified documents allegedly kept post-presidency at Trump’s Mar-a-Lago estate, and the other focusing on Trump’s alleged role in efforts to overturn the 2020 election results, leading up to the events of January 6.

With Trump’s victory in the 2024 election, both cases are at a turning point. Justice Department insiders reveal that Smith has asked for trial delays, citing the “unprecedented circumstances” surrounding Trump’s return to power. U.S. District Judge Tanya Chutkan granted this delay, effectively pausing the January 6 case proceedings.

The investigations have come with a hefty price tag, costing taxpayers around $50 million. Despite the extensive resources devoted to these cases, they may now face termination. A recent Supreme Court decision protects a sitting president from prosecution, and Trump’s presidency will further shield him from any ongoing legal proceedings.

Smith’s departure would likely bring an end to both cases. Judge Aileen Cannon, who previously ruled on the documents case, dismissed it, though Smith had appealed the decision. The January 6 investigation was expected to extend well into Trump’s new term, but with a delay in place, it may not survive Smith’s exit.

Smith, known for his rigorous approach, has asked DOJ and FBI personnel involved in these investigations to prepare for their own exits. His final act as Special Counsel will include filing a comprehensive report detailing his findings, set to be submitted to Attorney General Merrick Garland for potential public release.
