Douglass Mackey said his arrest five years ago over a political meme reflects what he described as a broader “domestic insurgency” involving federal prosecutors and the judiciary, during an exchange with Steve Bannon that revisited the case and its aftermath.

Bannon opened the discussion by marking the anniversary of Mackey’s arrest and asking whether Mackey believes the country is now in a form of political conflict.

“Doug Mackey, five years ago today, you were arrested for putting up a meme about Hillary Clinton. People still today can’t believe it. Now you’ve you’ve come out, and you’ve started with Cynthia Hughes, a new group to combat this. Are we at war or not? You’ve seen it. You’ve seen the sharp end of the stick. Do you believe we’re at war here.?” Bannon asked.

Mackey responded by characterizing his prosecution as part of a systemic effort that extends beyond his individual case.

“This is a domestic insurgency. I believe it is a war, and it goes, it runs from the streets all the way to the governor’s offices of some of these blue states and into the federal judiciary,” Mackey said.

“And five years ago, I was arrested, and there’s no better illustration of that than my case, when the justice system was instrumentalized with the eager assistance of the federal judiciary to go after MAGA myself, President Trump.”

Mackey said the charges brought against him were based on laws that he argued were never intended to apply to his conduct.

“We were hit with charges like the Klan Act, which a federal judge now refuses to sign charges on for Don Lemon,” he said.

“So when Trump was out of office, the federal judiciary went after us, and now that Trump’s back in office, they’re refusing to act to maintain law and order.”

He continued, “So this is absolutely a domestic insurgency situation, and this runs through the judiciary. It’s a judicial insurrection as well.”

Bannon then asked Mackey to clarify the basis of the charges against him and what actions led to his arrest.

“What can be done about it? You saw it, you know. Just remind people, what did you actually do? What was your crime, Sir?” Bannon said.

Mackey said the case centered on a meme he shared online during the 2016 election.

“Exactly. So I posted a meme, which I just found floating around the internet, saying, Hillary Clinton supporters could text their vote and they could skip the line, and nobody,” Mackey said. “The federal government tried to actually find people who were tricked by this meme. They couldn’t find anybody, because, first of all, it wasn’t targeted towards anybody. It was just a joke. It was a laugh.”

Mackey said prosecutors nonetheless pursued charges under the Klan Act.

“And for this, they brought Klan act charges for a law that’s almost 150, years old, that’s meant for people being lynched, people being beaten up for voting or using their First Amendment rights,” he said.

“So this is the the act they use against me.”

He said the prosecution highlighted what he views as the weaponization of federal institutions.

“We’re talking about weaponization, and it’s unbelievable,” Mackey said.

Mackey also criticized the pace of changes within federal law enforcement leadership, arguing that most U.S. attorney offices remain staffed by career officials.

“But one thing I would urge the president to do, there’s only really been one us, attorney’s office that’s been cleaned out, and that would be DC, and there’s 94 other offices,” he said.

“There were the career the career bureaucrats are still in place.”

He said his indictment occurred shortly after President Joe Biden took office.

“I wish I could blame Biden for indicting me, but the fact is, when I was indicted, it was only seven days after Biden was inaugurated, and Biden didn’t have his US attorney in place. He didn’t have his attorney general in place,” Mackey said.

“These were prosecutions that were instigated by career bureaucrats in the system, and these people are still burrowed in,” he added.

Mackey warned that similar prosecutions could happen again in the future.

“They’re biding their time for January, 20, 2029, and seven days after Biden was inaugurated, I was arrested, and the same exact thing can happen all over again with a complicit federal judiciary and US Attorney’s offices that don’t obey the president and that don’t really have any sense of fairness,” he said.

Bannon echoed Mackey’s concerns, saying that only one U.S. attorney’s office has seen significant changes and that confirmation delays have slowed additional appointments.

“This is the point. Also, you can’t get, remember, President Trump in Maine justice, he can’t get guys approved. We’ve only gotten 14 of the 94 US attorneys, and only one office has been cleaned out,” Bannon said.

Bannon described what he called resistance within the system and argued that the political divide extends beyond policy disagreements.

“They’re at war with us. This is not your your your parents or grandparents Democratic Party,” Bannon said.

As the discussion concluded, Mackey directed viewers to his current efforts.

“And like I said, these are not FDR, New Deal Democrats. These are vicious communists, the type that slit babies throats and put precept against the wall in Spain and Russia. And this is a communist insurrection.”

Bannon closed the segment by praising Mackey.

“Doug Mackey, you’re a hero, a patriot,” Bannon said.
