The FBI has provided key documents to Congress related to Justice Department actions under Joe Biden, following a subpoena from House Judiciary Committee Chairman Jim Jordan.
The records, which were requested in late February, focus on several controversial investigations and policies, including the targeting of parents at school board meetings, surveillance of Catholics, and enforcement of the Freedom of Access to Clinic Entrances (FACE) Act.
FBI Assistant Director Marshall Yates confirmed the document handover in a letter to Jordan on Friday.

The released records include internal FBI documents related to former Attorney General Merrick Garland’s October 2021 school board memorandum.

The memo directed federal agencies to investigate parents protesting at school board meetings, which Republicans have argued was an attempt to silence concerned families.
The FBI’s response to Jordan’s subpoena also included materials tied to the Richmond, Virginia, field office’s now-retracted memo that linked “radical-traditionalist Catholic” ideology to domestic extremism, as well as records concerning investigations under the FACE Act.
Jordan has been investigating what he calls “the weaponization of federal law enforcement against the American people” during Biden’s presidency.
He previously accused former FBI Director Christopher Wray of stonewalling congressional subpoenas and urged Patel, who now leads the bureau, to restore transparency.

“It is important that you succeed in restoring public confidence and creating much-needed transparency,” Jordan wrote to Patel last month.
Following the document release, Jordan’s spokesman, Russell Dye, said, “We are thankful for Director Patel’s work, and we will have more updates soon.”
As part of the release, the FBI provided “additional documents” concerning its handling of school board-related investigations.
The bureau confirmed that the “EDUOFFICIALS” threat tag, which had been used to track concerns about parents protesting school policies, had not been assigned to any new cases since August 2022.
However, it acknowledged that an additional “Guardian” case—now closed—had been classified and would be delivered to Congress under secure arrangements.
Jordan has long questioned how quickly the FBI moved to implement Garland’s directive and whether bureau officials raised concerns about potential violations of civil liberties.
In November 2021, he released whistleblower testimony indicating that FBI counterterrorism resources had been used to track parents speaking out at school board meetings.
An internal email he obtained showed that FBI officials were directed to apply a “threat tag” to monitor interactions between parents and school administrators.
The newly released records also pertain to the FBI’s controversial Richmond Field Office memo from January 2023, which attempted to link “racially or ethnically motivated violent extremists” (RMVEs) to so-called “radical-traditionalist Catholic” (RTC) ideology.
Jordan had previously argued that the memo led to federal law enforcement infiltrating places of worship.
He also accused the FBI under Wray of failing to provide adequate information about the sources used to justify the memo, including intelligence gathered from left-wing media outlets.
The Richmond memo relied on articles from the Southern Poverty Law Center, The Atlantic, and Salon, which framed traditional Catholicism as a potential breeding ground for extremism.
The FBI later admitted that the report “did not meet the exacting standards of the FBI” and took steps to retract it.
However, a 2024 report by DOJ Inspector General Michael Horowitz found that the memo contained “significant problems,” including insufficient evidence to justify linking traditional Catholic views to extremist activity.
The FBI’s latest submission to Congress also includes details on investigations tied to the FACE Act, which has been criticized for its perceived bias in enforcement.
The bureau revealed that since May 2022, it had opened 55 FACE Act-related investigations:
- One case involved a facility providing abortion services.
- 31 cases involved pregnancy resource centers.
- 23 cases involved facilities offering both abortion services and pregnancy resources.
Jordan has accused the FBI and Justice Department of enforcing the FACE Act selectively to shield pro-abortion activists while aggressively prosecuting pro-life advocates.
He has also criticized the FBI’s use of “aggressive law enforcement tactics” against pro-life individuals.
Attorney General Pam Bondi, who took office in January, rescinded Garland’s school board memo in a footnote earlier this year.
She also announced the formation of a “Weaponization Working Group” tasked with reviewing DOJ and FBI actions that may have been politically motivated.
Bondi’s group is specifically investigating the school board memo, the anti-Catholic FBI memo, and the application of the FACE Act.
The review is expected to play a key role in determining whether further accountability measures are necessary.
FBI spokesman Ben Williamson emphasized that the agency is committed to fulfilling congressional oversight requests under Patel’s leadership.
“Kash Patel’s FBI was given a mandate to open up the books and engage in transparency efforts at levels never before seen – and our Congressional Affairs team is stepping up to the plate,” Williamson told Just the News.
“We will continue to work diligently with Chairman Jordan and Chairman Grassley to ensure the American people get the information they deserve.”
The FBI had already handed over an initial batch of records earlier in March, which included documents related to Garland’s school board memo, the investigation into January 6th pipe bombs, and the FBI’s now-defunct Foreign Influence Task Force.
As Jordan continues his inquiry, additional disclosures may follow, shedding further light on how the Biden-era DOJ handled key investigations.
