The Federal Bureau of Investigation is conducting a criminal investigation into the organizers and funders of anti-ICE protests, according to an exchange between Eric Bolling and investigative journalist John Solomon, who said recent statements from FBI Director Kash Patel mark a significant shift in how federal authorities view protest activity that interferes with law enforcement.
During the exchange, Bolling asked Solomon to clarify what Patel had disclosed earlier in the day regarding the protests.
“Kash Patel told you what today?” Bolling asked.
Solomon responded by outlining what he said the FBI director confirmed about the scope and purpose of the investigation.
“Yeah, that the FBI does, in fact, have a criminal investigation into the organizers and funders of these anti ICE protests,” Solomon said.
Solomon said Patel made clear that protest activity resulting in interference with Immigration and Customs Enforcement operations could expose organizers to serious criminal charges.
“Anyone, he said, who organized something that resulted in the obstruction of a law enforcement proceeding an operation by ICE could be charged with obstruction of justice,” Solomon said.

According to Solomon, Patel’s remarks represent an unprecedented public stance by the FBI regarding the limits of First Amendment protections during protests.
“That is the first time ever that I know of that an FBI director has said that and told protesters This is not First Amendment protected activity,” Solomon said.
Solomon explained that Patel distinguished between lawful protest and actions that physically obstruct or interfere with officers carrying out their duties.
“You can shout and yell and have your slogans and your posters,” Solomon said.
He said the line is crossed when protesters take actions that impede ICE operations.
“The second you pull a car in front of an ICE officer, the second you throw a snowball at an ICE officer, the second you try to trip up, stop and peed, the second you tip off people that ICE are coming in an operation, you have crossed over from free speech protection to obstruction of justice,” Solomon said.
Solomon said the FBI director’s clarification could lead to swift enforcement actions.
“And that, I think, is going to be the big news in the next few days,” Solomon said.
He added that federal authorities may soon move against those responsible for organizing or financing the protests.
“I would not be surprised if we saw some law enforcement activity targeting the organizers and funders of the protests in the next few days,” Solomon said.
