Federal Grand Jury in SoCal Indicts Two Surgery Center Workers for ICE Capades

I know how we sort of expected it, but were still bitterly disappointed when a D.C. grand jury failed to indict a former Department of Justice employee for his vicious attack on immigration enforcement with a deli sandwich.

Federal prosecutors failed to persuade a DC grand jury on Tuesday to hand up a felony indictment against the ex-Department of Justice employee who threw a Subway sandwich at a Customs and Border Protection agent on the streets of Washington DC earlier this month.

Prosecutors in DC US Attorney Jeanine Pirro’s office convened the panel after Sean Charles Dunn was charged Aug. 13 with felony assault for slinging the sub at the chest of the federal officer three days prior.

But they were unable to convince grand jurors to approve the bill of indictment, the New York Times and NBC News reported Wednesday, citing sources familiar with the proceedings.

Seriously. He should have gone to the Big House for years just for the girlish skittering out of the way.

Cripes. No one expects you to run like O.J., but at least run like MAN, not like a four-year-old girl from nasty Billy Snerdly in the playground with a worm.

That explains a lot.

In any event, that was a momentary disappointment, and he’s still out of a job in a very expensive town, folk hero in fevered minds that he is.

Here’s a feel-good story to help make up for it, and out of Southern California no less. I thought I’d share.

Federal authorities have arrested a staff member at a medical clinic in Ontario, California, for interfering with a U.S. ICE operation.

What had happened was:

…Earlier this month, Honduran national Denis Guillen-Solis attempted to evade law enforcement by fleeing on foot. He ran into the Ontario Advanced Surgical Center, where he was not a patient. Inside the clinic, two staff members—Jose De Jesus Ortega and Danielle Nadine Davila—physically confronted and interfered with ICE agents attempting to apprehend Guillen-Solis.

According to federal prosecutors, the pair forcibly assaulted, impeded, and obstructed officers during the arrest, and conspired to prevent federal agents from carrying out their duties through force and intimidation.

As they have the ICE officer physically shoved back against the wall, and it’s all on video, I’d say so.

…According to court documents, two U.S. Immigration and Customs Enforcement officers were conducting raids in Ontario on July 8 while wearing government-issued equipment, including law enforcement vests, the release states.

The agents followed a truck with three men inside and approached them after the men exited the truck in the parking lot of the surgery center, according to the release. Two of the men ran away; one of them, an allegedly unauthorized immigrant from Honduras, was detained near the facility’s front entrance and tried to pull away, causing him and an ICE officer to fall to the ground.

A medical staffer helped the landscape worker off the ground and pulled him away from the officers, according to the release. The man went into the surgery center and was chased by the ICE agent, who eventually stopped him.

According to video obtained by KTLA-TV, staffers told the two agents to leave because they didn’t have a warrant to enter the property. The agents were trying to detain 30-year-old Denis Guillen-Solis and two other landscapers, according to the release.

In the video, Guillen-Solis is shown holding on to the doorway at the surgical center and asking the agents to present identification. The agents then pulled Guillen-Solis from the doorway and detained him.

Davila allegedly interfered with the arrest by wedging herself in front of the officer and saying, “Let him go!” and “Get out,” according to the release. Ortega allegedly interfered by grabbing the officer’s arm and vest.

I’m no Denny Crain – I only play one here at HotAir – but I would think when federal authorities are in lawful pursuit of a suspect and you throw yourself in between, and start screeching about a warrant, you’re probably wrong.

Apparently, whatever arguments U.S. Attorney for the Central District Bill Essayli and his peeps made were compelling enough, because a grand jury in hostile SoCal indicted both of them today on federal charges.

…Jose de Jesus Ortega, 38, of Highland and Danielle Nadine Davila, 33, of Corona each were indicted on Wednesday, Aug. 27, of one count of assaulting, resisting and impeding a federal officer, according to the U.S. Department of Justice.

Essayli is pretty clear that, as long as it’s up to him, he’s not going to let you get away with that.

…“This story is another example of a false narrative echoed in the media in furtherance of an agenda to delegitimize federal agents,” U.S. Attorney Bill Essayli in a statement when charges were first announced July 25, said of coverage of what occurred. “The illegal alien arrested inside the surgery center was not a patient. He ran inside for cover and these defendants attempted to block his apprehension by assaulting our agents.”

The defense attorney says Essayli’s just being mean because the two miscreants wouldn’t plead to a misdemeanor charge.

WAAH!

“It seems vindictive if you ask me,” said Oliver Cleary, Davila’s attorney.

‘It seems like your clients are really stupid to do that to begin with and then to turn down a helluva break, if you ask me,‘ said ME, who is not a defense attorney but maybe I should be.

Now, instead of basically a ticket, the mah-roons are looking at eight years.

Essayli isn’t messing around in many of these cases, but it doesn’t seem like word’s getting out. A Walmart employee found out last week that you don’t take the trash out when ICE needs to get by in pursuit.

A former Walmart employee who tried to intervene as Border Patrol agents arrested an undocumented custodial worker in Pico Rivera in June was indicted by a federal grand jury Wednesday.

Adrian Martinez, 20, was indicted by a Santa Ana jury on the charge of conspiracy to impede a federal officer tied to the events of June 17, which unfolded at the height of the Trump administration’s immigration raids in the Los Angeles area. Martinez’s violent arrest was caught on video and quickly went viral.

According to the three-page indictment, Martinez confronted Border Patrol agents as they tried to arrest the custodial worker in the parking lot of a shopping center and blocked the agents’ vehicle with his own. Prosecutors allege that he positioned himself with a growing crowd to surround the agents’ vehicle and prevent it from leaving the area.

Martinez then allegedly grabbed a large trash can and moved it in front of the agents’ vehicle, blocking them from being able to pass.

The LA Times version left out the part about ‘punching an officer in the face.’ Go figure.

And he’s being aggressive about seeking indictments outside of even more hostile Los Angeles County.

The guy means business.

…Martinez’s lawyers released a statement noting that “just as in other cases arising out of recent illegal and inhumane ICE raids, the U.S. Attorney’s Office had to travel out of Los Angeles county to secure this indictment.”
