The State of Florida and the Florida Department of State (FDOS) filed a lawsuit Wednesday against the Department of Homeland Security (DHS) and Secretary Alejandro Mayorkas for allegedly refusing to verify the citizenship status of certain voters.
The lawsuit alleges DHS failed to provide information regarding the immigration status of specific individuals registered to vote in Florida. Typically, Florida relies on the SAVE program, an online tool for government agencies to determine an individual’s immigration status, according to the complaint. However, Florida cannot use SAVE to verify a person’s legal status if it does not have an immigration identifier assigned by the federal government for that individual, according to the lawsuit.

The Daily Caller reached out to the DHS and U.S. Citizenship and Immigration Services, but has not heard back at the time of publication.
“Thus, Florida has identified a subset of individuals for whom it cannot verify citizenship or immigration status through SAVE and for whom DHS refuses to verify citizenship or immigration status through other means,” the documents read. Even if Florida were able to verify the citizenship status of these individuals without support from the DHS, it would cause the state to expend resources, the lawsuit says. Florida cannot ensure election integrity and the accuracy of voter rolls without additional information from the agency, the complaint adds.
The lawsuit alleges the defendants did not provide timely information to FDOS to verify the immigration status of the individuals Florida identified.
The lawsuit seeks an order “compelling” the defendants to respond to Florida’s inquiries in addition to permanent injunctive relief, among other relief awards.

Other states have also raised concerns about potential non-citizen voters, including Oregon, where hundreds of ineligible voters were registered to vote. In one North Carolina county, there were almost 20 reports of voter impersonation.
