The Department of Homeland Security said Monday that an arrest of Rep. Alexandria Ocasio-Cortez (D-NY) could be “on the table” if she engages in unlawful conduct at a U.S. Immigration and Customs Enforcement facility, following a recent altercation involving Democratic lawmakers in New Jersey, as reported by The Western Journal.
DHS Assistant Secretary for Public Affairs Tricia McLaughlin made the comment during an appearance on Fox Business, where she was asked whether Ocasio-Cortez could face legal consequences if she attempted to replicate the actions that led to the arrest of Newark Mayor Ras Baraka at the Delaney Hall ICE detention center.
“If she trespasses and if she assaults law enforcement officers, as we saw earlier, I think that that’s certainly on the table,” McLaughlin told co-host David Asman on The Bottom Line.

Ocasio-Cortez had posted a video to Instagram on Sunday defending the actions of Baraka and other Democrats who were involved in the incident at the facility.

The video included a warning to DHS officials, saying there would be a “problem” if any lawmaker was touched during such visits.
“You lay a finger on Representative Bonnie Watson Coleman or any of the representatives that were there, you lay a finger on them, and we’re going to have a problem,” Ocasio-Cortez said.

The incident at the Delaney Hall facility occurred Friday, when Baraka, joined by Reps. Rob Menendez Jr., Bonnie Watson Coleman, and LaMonica McIver, attempted to enter the facility.
According to DHS, the group was at a security checkpoint with a group of protesters and tried to force entry as the gates opened for a detention bus.
“We know that’s baloney because had they asked us, had they requested a tour, we would have happily facilitated that for them,” McLaughlin said. She added that DHS has public guidelines requiring 24 hours’ notice for facility visits.
DHS later released bodycam footage on X, showing the confrontation and claiming that Rep. McIver assaulted an ICE agent during the incident. The video was made public as Democratic lawmakers pushed back on the agency’s characterization.

Coleman’s office told Axios that the lawmakers were there to “exercise their oversight authority” and were eventually escorted into the facility. On CNN’s State of the Union, the Democrats accused the agency of creating the chaos.
McLaughlin defended the agents’ response, stating the facility currently houses dangerous individuals, including “rapists, child predators, an MS-13 gang member, even a suspected terrorist.”
