Internal communications obtained through Freedom of Information Act requests reveal that the Biden-Harris administration privately acknowledged the presence of potentially cancer-causing toxins in East Palestine, Ohio, after the February 2023 Norfolk Southern train derailment.
This comes despite repeated public assurances that the area was safe for residents.

In a March 29, 2024, email, FEMA recovery leader James McPherson wrote to other public health officials stating, “The occurrence of a cancer-cluster in EP [East Palestine] is not zero.”
He added, “As you all are aware, the first 48 hours of the fire created a really toxic plume.”

The email was part of a set of communications first reported by NewsNation.
This acknowledgment came just two months after Joe Biden criticized “multimillion-dollar railroad companies transporting toxic chemicals” during a public address but praised his administration’s “herculean efforts” to resolve the “vast majority” of problems in East Palestine.
The derailment on February 3, 2023, resulted in the release of large quantities of hazardous materials, including 115,000 gallons of vinyl chloride, a known carcinogen.
An open burn of the chemical was conducted as part of the emergency response.
Residents were displaced, and there were reports of strange illnesses and livestock deaths in the days and weeks following the incident.
Environmental Protection Agency Administrator Michael Regan visited East Palestine on February 22, 2023.
During the visit, he was filmed drinking from the local water supply. In an October 17, 2023, statement, Regan said, “Since the disaster, EPA has collected more than 100 million air monitoring data points and more than 25 thousand samples in and around the community.”
He added, “Ongoing science-based reviews show that residents of East Palestine are not in danger from contaminated drinking water, soil, or air from the derailment.”
However, investigators from the Government Accountability Project have challenged the administration’s handling of the crisis.
Lesley Pacey, an investigator with the group, told The New York Post that the federal response was flawed from the beginning.
“They didn’t always test for the right chemicals; they didn’t test in the right locations; they didn’t have the right detection limits,” Pacey said.
“They delayed testing for dioxin, and then when they did the testing for dioxin — and also did the testing in people’s homes for other chemicals — they used Norfolk Southern contractors, and those contractors used equipment that wasn’t correct.”

Pacey also noted that ASPECT aircraft, which are designed to monitor air quality after chemical incidents, were not deployed until four days after the derailment due to weather. Standard procedure calls for deployment within eight hours of an event.
According to Pacey, the administration’s failure to follow proper protocols extended to water monitoring and chemical burn decisions.
“They completely botched this event from the very beginning,” she said, adding that residents in the area became “very, very ill.”
Additional emails from FEMA, the EPA, the White House, the National Security Council, and the Department of Justice show that one year after the derailment, federal officials were still discussing the need to develop a “tripwire to identify cancer clusters.”
The Justice Department later reached a settlement with Norfolk Southern totaling $310 million for damages related to the derailment and its aftermath.
Joe Biden, who was diagnosed earlier this month with an aggressive form of prostate cancer that has reportedly spread to his bones, has previously linked toxic exposure to cancer.
He has said that his son Beau Biden’s brain cancer may have been caused by burn pit exposure during military service in Iraq.
In a 2022 speech, Biden also stated that he had cancer from growing up near oil refineries in Claymont, Delaware.
The White House later clarified that he was referring to previously removed non-melanoma skin cancers.
