Judge Overturns Somali Fraud Conviction Based on ‘Feelz’

Judge Overturns Somali Fraud Conviction Based on ‘Feelz’

Judges can overturn legal convictions if there is a fundamental legal error that endangers the rights of the accused and/or the integrity of the judicial system. 





What they are not supposed to do is substitute their “feelz” for that of a jury of the accused’s peers. 

But that only applies if the judge acts as the legal arbiter in the case, and not as a Demigod who gets to decide based on their mood or political inclinations. 

🚨 BREAKING: A judge in deep blue Hennepin County has OVERTURNED the guilty verdict of Abdifatah Yusuf after stealing $7.2M from taxpayers.

The ruling could now open the door for other fraud convictions in Minnesota to be overturned.

Nobody questions whether there has been fraud in the Minnesota Medicaid program, nor even that fraud was uncovered in this particular case. But the judge has decided that the jury might be wrong, not because there is any evidence that they were in fact wrong, but rather that she can imagine alternative theories of the case. 

Essentially, since there is no video evidence that the defendants chatted on video that they were having a fine old time cheating the system, perhaps it was aliens or some unknown third party. 

(Yes, I am using a bit of hyperbole here, but honestly, the jury decided that their guilt was obvious, and the judge’s “feelz” are not supposed to override their conclusion without evidence that there was a legal defect). 





The jury quickly found the couple guilty. Now, a judge in Hennepin County, Sarah West, has overturned that verdict.

“It’s reversing or overturning a jury’s verdict,” said defense attorney Joe Tamburino. Tamburino was not affiliated with Yusuf’s case but looked at the judge’s decision.

According to Tamburino, Judge West said the state’s case relied “heavily on circumstantial evidence” and that the state did not “exclude other reasonable, rational inferences.”

“That, in fact, there could’ve been other reasonable theories other than guilt in this case. That’s what it comes down to,” Tamburino said.

Judge West herself said she was “troubled” by the fraud in this case. 

State Rep. Kristin Robbins, chair of the House Fraud Prevention and State Oversight Committee, said she was “stunned” by Judge West’s ruling.

Even the judge admits there is fraud. The jury found the evidence not just compelling, but so compelling that it took no time to convict. It wasn’t even a close call, as some prominent trials involving slick lawyers can be. As with racketeering, the evidence stacked up, and the jury was convinced. 

We have no evidence that Judge West was influenced by DEI concerns, because the defendants were Somali, and I wouldn’t say that my speculation that sympathy for Somalis motivated her. Perhaps she has other reasons. 





But I sure suspect that if the defendants were not Somalis, she wouldn’t have made this decision. That is the reason why this fraud ring has gotten away with stealing hundreds of millions or more over the past few years. 

Judge Sarah West didn’t just overturn a jury who convicted Abdifatah Yusuf of stealing millions from taxpayers, she didn’t even really explain why except that he could’ve not been guilty.

The fraud epidemic has upended our social welfare system, with some programs shutting down and others suspending payments until fully investigated. 

But that doesn’t matter, apparently. Juries don’t matter. Nothing, apparently, matters but feelz.
