According to Immigration and Customs Enforcement (ICE) data provided to lawmakers, tens of thousands of illegal immigrants with criminal convictions, including serious offenses like homicide and sexual assault, are currently at large in the United States.
The data, which was shared with Rep. Tony Gonzales, R-Texas, outlines the scope of the issue as of July 2024 and provides details about illegal immigrants who are either going through removal proceedings or have already been ordered removed but are not detained by ICE.
The non-detained docket, which includes individuals not in ICE custody, currently holds more than 7 million people. Among those on the docket, 425,431 are convicted criminals, while 222,141 have pending criminal charges.

The offenses range from assault and burglary to drug convictions, kidnapping, sexual assault, and even homicide.
The data reveals that 62,231 individuals have been convicted of assault, 14,301 of burglary, 56,533 of drug-related crimes, and 13,099 of homicide.
Additionally, 2,521 individuals have kidnapping convictions, and 15,811 have been convicted of sexual assault. There are also 1,845 individuals facing pending homicide charges, along with 42,915 assault charges and 3,266 burglary charges.
Rep. Tony Gonzales responded to the data with alarm, emphasizing the dangers posed by these individuals. “As of July 21, 2024, there were 662,566 noncitizens with criminal histories on ICE’s national docket—13,099 criminally convicted MURDERS!” Gonzales said in a statement. “Americans deserve to be SAFE in our own communities.”
The ICE report also criticized so-called “sanctuary” cities, which limit cooperation with federal immigration authorities. In its statement, ICE warned that sanctuary policies can shield dangerous criminals from deportation, putting communities at risk. “Sanctuary policies can end up shielding dangerous criminals, who often victimize those same communities,” ICE stated.

Despite the ongoing concerns, ICE and the Department of Homeland Security (DHS) highlighted their efforts to enforce immigration laws and remove illegal immigrants.
According to the agency, from mid-May 2023 through the end of July 2024, DHS removed or returned more than 893,600 individuals, including over 138,300 in family units.
The agency added that most of the individuals encountered at the Southwest Border in the past three years have been removed, returned, or expelled.
However, the Biden administration has faced criticism for its handling of the border crisis, particularly for the release of many migrants into the interior of the country.
While deportations have increased in recent years, they remain well below the levels seen under the Trump administration.
In fiscal year 2023, there were 142,580 removals, up from 72,177 in fiscal year 2022 and 59,011 in fiscal year 2021.
However, these numbers are still significantly lower than the 267,258 removals in fiscal year 2019 under Trump.
Republicans have pointed to the increase in the non-detained docket as evidence of the administration’s failure to control the border.
The number of individuals on the non-detained docket has grown from 3.7 million in fiscal year 2021 to nearly 4.8 million in fiscal year 2022 and over 7 million in fiscal year 2023.
Many conservatives, including House Homeland Security Committee Chairman Mark Green, have criticized the administration’s policies, blaming them for the surge in illegal immigration and the release of criminals into the U.S. “It may be shocking to hear that the Biden-Harris administration is actively releasing tens of thousands of criminal illegal aliens into our communities, but their own numbers conclusively prove this to be the case. This defies all common sense,” Green told Fox News.
He also condemned Vice President Kamala Harris, who is responsible for overseeing border issues. “Under President Biden and his ‘border czar,’ Vice President Harris, DHS law enforcement has been directed to mass-release illegal aliens whom they know have criminal convictions or are facing charges for serious crimes—and these dangerous, destructive individuals are making their way into every city and state in this country.”
In particular, the administration has backed a bipartisan Senate bill that would increase the number of ICE detention beds.
However, Republicans have largely rejected the bill, arguing that current resources are not being fully utilized.
Kamala Harris is set to visit the southern border in Arizona later today as part of her efforts to address ongoing criticism over the administration’s handling of the border crisis.
Conservatives, however, remain skeptical of her efforts. RJ Hauman, president of the National Immigration Center for Enforcement (NICE), stated, “Border Czar Kamala Harris has had nearly four years to protect America and failed… She puts criminals first and the safety and security of you and your family last.”
As the debate over immigration continues, the release of this data is sure to add fuel to the ongoing political battle over the nation’s border policies.
