Nicholas Roske, the man who flew across the country and headed to Justice Kavanaugh’s neighborhood with a gun in hopes of executing him, and possibly other Supreme Court Justices, was sentenced today. Prosecutors wanted the judge to give Roske 30 years, which was the recommended sentence based on guidelines. Instead, the judge gave him just 8 years.





The 29-year-old Californian who flew across the country to assassinate Supreme Court Justice Brett M. Kavanaugh was sentenced to eight years in prison Friday…

The punishment was 22 years less than the minimum of 30 years sought by prosecutors.

Boardman cited Roske’s decision to call 911 after arriving in Kavanaugh’s neighborhood in 2022 and Roske’s lack of criminal history. Federal sentencing guidelines in the case, while not binding, also recommended a sentence of at least 30 years.

But those weren’t the only reasons the judge cited. Roske’s attorneys recently revealed that he is trans and began transitioning before the attack.

In a recent court filing, attorneys representing Roske said their client goes by Sophie Roske and is transgender. Roske began transitioning in 2020, the filing says. Roske’s name in court headings remains Nicholas Roske. In court Friday, Roske’s attorneys and Boardman referred to the defendant as Ms. Roske.

Judge Boardman, a Biden appointee, also limited the sentence out of concern that Roske wouldn’t be able to get gender-affirming care in a male prison.

The judge also said that a lower sentence was warranted because of an executive order issued by President Trump mandating that transgender women be held at male-only federal facilities, which she said could interfere with her continuing to receive gender transition care. Judge Boardman also sentenced Ms. Roske to supervised release, after her prison sentence is complete, for the rest of her life.





The NY Times refers to Roske as she and her throughout.

Sophie Roske was sentenced to just over eight years — 97 months — in prison on Friday for a 2022 attempt to assassinate Justice Brett M. Kavanaugh of the Supreme Court…

Ms. Roske, wearing yellow prison scrubs and ankle shackles, apologized to Justice Kavanaugh and to the judiciary as a whole “for contributing to the fear judges experience as a result of doing their jobs.” She spoke in a halting voice, fighting back tears and leaning on her counsels’ table. Sitting behind her in the gallery were her parents and younger sister…

Her plan, she later told the police, was to break into Justice Kavanaugh’s home, kill him and then kill herself. She said she was angry about one of the Supreme Court’s most consequential cases — a leaked draft of an opinion that showed the justices were preparing to end a constitutional right to abortion.

Hopefully the DOJ is going to appeal this light sentence. 

The DOJ is able to appeal the sentence because it is well under the sentencing guidelines.

The sentence seems especially light given the rise of political violence since then. We just had the assassination of Charlie Kirk a few weeks ago, not to mention two attempts on Trump’s life. Sending the message, now, that attempted assassination will be given a slap on the wrist (at least if you claim to be trans) seems very irresponsible.

Update: The DOJ does plan to appeal this sentence. This is cringe-worthy stuff.





His mom told the judge “I have attended PFLAG meetings and learned about the LgBTQ+ community. I am committed to going on this journey with Sophie.” Kavanaugh’s family did not speak but looked pained.

“Why do you think that Ms. Roske, sitting here three years later, poses a danger to the public?” Judge Boardman asked. “We can agree Ms. Roske neeeds intensive therapy. Will she be provided that in the Bureau of Prisons?”

Boardman said “The length doesn’t need to be particularly long… unduly harsh conditions make a difference, too… She will be imprisoned in a male facility even though she is a transgender prisoner, pursuant to an executive order from the president.”
