“Outnumbered” co-host Kayleigh McEnany delivered a fact check to Democratic Mayor Brandon Johnson of Chicago and Democratic Gov. J.B. Pritzker of Illinois Wednesday over the deployment of National Guard troops.
President Donald Trump hinted at stepped-up federal enforcement efforts in Chicago in an August 25 post on Truth Social, following it up with a meme based on a famous character from the movie “Apocalypse Now” posted Sept. 6. After a clip of Johnson complaining about federal enforcement efforts was played at the request of “Outnumbered” co-host Harris Faulkner, McEnany explained the law. “I just want to give Mayor Brandon Johnson of Chicago, the authorities of Chicago, J.B. Pritzker, a little constitutional law lesson,” McEnany said. “Number one, what is happening in Chicago is entirely different than we are talking about in Portland and Memphis. Number one, ICE is conducting operations they have the federal authority to conduct. The Supreme Court has been crystal clear, ICE can conduct operations, sole purview of federal government, number one.”

“Number two, federal agents have been deployed to protect an ICE facility,’ McEnany continued. “Oh, wait, where do you have authority for that? Pretty clear, I cited that from the podium when we did this to protect the Portland courthouse: 40 USC 1315. You can deputize officers to protect federal property.”
Federal agents were forced to fire pepper balls at the rioters during a riot outside the Chicago-area ICE facility on Friday, according to video posted on X by multiple accounts, with some of the rioters being arrested. Some of the rioters called for the ICE agents to be arrested or shot in another video posted online.
“Well, why do they need federal protection in Chicago at that ICE facility? Because DHS tweeted pictures of what was found outside that ICE facility: Guns, handguns, weapons, 11 people arrested outside that facility,” McEnany said. “Donald Trump is crystal clear within his authority when he says I’m protecting an ICE facility and he deploys ICE to conduct operations.”
At least one person was killed during a shooting at an ICE office in Dallas on Sept. 24, with the gunman taking his own life. In Texas, there were two previous incidents where shots were fired at ICE or Border Patrol facilities since July 4, with ten people being charged with attempted murder in connection with the former incident.
Resistance to ICE operations included a Milwaukee judge who allegedly helped an illegal immigrant briefly evade ICE agents in April and Democratic Mayor Freddie O’Connell of Nashville releasing the names of ICE agents involved in a crackdown on illegal immigrants in the city in May. In New York City, ICE agents arrested former Democratic mayoral candidate Brad Lander on June 18 after he allegedly interfered with an ICE operation in a Manhattan court. Democratic Rep. LaMonica McIver of New Jersey was charged with assaulting an ICE agent after a May incident at an ICE facility in Newark.
