Krasner Begs Trump: Please Make Me a Political Martyr!

And the funniest part? Donald Trump might just accommodate Larry Krasner … assuming that Philly’s radical DA is foolish enough to follow through on this truly idiotic threat.

Krasner’s clown show began earlier this week when the DA threatened federal immigration enforcement officials at the airport. Krasner starts off by warning that if any ICE agents commit crimes in his jurisdiction, “I prosecute you. That is how it works.” That itself must be news to the people of the city and county of Philadelphia about the George Soros-backed DA, who has implemented radical-progressive policies that mainly avoid prosecutions and imprisonment. 

“The president cannot pardon you,” Krasner warns. “I will put you in handcuffs. And if necessary,” Krasner threatened, “I will put you in a jail cell,” again a promise of a rather massive shift in Krasner’s track record. After people began scoffing at his bravado, Krasner quote-tweeted to double down on the threat:

And he’s still an idiot for doing so.

To get a sense of Krasner’s competence as a prosecutor, pay attention to how he framed the two deaths in Minneapolis during ICE operations. He claimed the deceased were “unarmed,” but that’s absolutely false. Alex Pretti had a firearm on him when he attempted to obstruct an arrest, which is what prompted the ICE agents to open fire. (That doesn’t in itself justify the shooting, but Pretti was armed nonetheless, despite Krasner’s claim.) The other deceased individual, Renee Good, hit an ICE agent with her car while attempting to flee from agents attempting to detain her for obstruction. That was an assault with a deadly weapon; Good may not have carried a firearm, but she used her car to attack federal law enforcement, so suggesting she was “unarmed” in the sense of defenselessness is a flat-out lie. 

Also: Had local and state political leadership allowed the police to coordinate with ICE in a professional manner, both Pretti and Good would be alive today. Mark Ross, the president of St. Paul’s police union, made that explicitly clear after the Pretti shooting. ICE and Border Patrol agents got forced into crowd control to deal with protesters riled up in large part by Minneapolis mayor Jacob Frey and Minnesota governor Tim Walz, who then withheld cooperation as a way to intimidate ICE into withdrawing. Krasner’s trying to gin up the same kind of radical response in the airport to create crises that could result in violence, by which Krasner believes he can generate arrests and prosecutions.

However, Krasner either forgets about or entirely ignores the Supremacy Clause in the US Constitution. Local DAs and state Attorneys General do not have jurisdiction over federal officers performing statutory duties. Only the Department of Justice can prosecute such cases. If Krasner attempted what he threatens here, the defendants and the DoJ would immediately file motions to remove such cases to federal court under the DoJ’s jurisdiction, either for prosecution there or for dismissal. (As an aside: People may recall that Trump and Mark Meadows attempted this in Georgia during the Fani Willis RICO debacle, but the court ruled that they were acting as candidates rather than federal officers and ruled against removal.)

If Krasner doesn’t know this, he should be disbarred for complete incompetence. If Krasner does know this, he should be disbarred for threatening to abuse his office for blatantly political demagoguery, 

And if Krasner actually attempts this, he might get disbarred for committing a felony. Any attempt to arrest an ICE agent while performing his duties by someone without authority or jurisdiction over them would be obstruction of federal law enforcement, which can be charged at a felony level. LaMonica McIver found that out the hard way last year, after the House Democrat assaulted multiple immigration officers at a detention center in Newark when they attempted to arrest Mayor Ras Baraka for forcing entry into the facility. As I pointed out at the time, 18 USC 111 doesn’t even require physical contact to prosecute this circumstance as a felony, but grabbing an agent would almost certainly lead the DoJ to escalate that charge to felony level for Krasner and anyone else conspiring to obstruct federal law enforcement operations. 

Mike Davis, formerly chief counsel for the Senate Judiciary Committee and a clerk for Justice Neil Gorsuch, laid out the case on Twitter yesterday (via Twitchy):

Dear @DA_LarryKrasner:

If you attempt to arrest a federal officer for doing his job, you could face federal felony charges:

– Assault

– Obstruction

– Harboring

– Conspiracy

A federal officer could use deadly force to protect himself.

If anyone dies:

If Krasner put an agent in a jail cell, the DoJ could add false imprisonment, too. Assault and obstruction would be slam-dunks. 

Krasner can’t possibly be this stupid, though. He’s attempting to demagogue in hopes of ginning up mobs of activists to create the crises he wants to exploit, but he’s not going to get his own skirts dirty with the blood that flows from them. But if he did, Krasner would be trying to turn himself into a martyr for his own ambitions … and Trump, Pam Bondi, and Harmeet Dhillon might be willing to accommodate that desire.
