Homeland Security Secretary Kristi Noem delivered a blunt two-word response after a high-profile lawsuit brought by the American Civil Liberties Union (ACLU) on behalf of detained illegal immigrants was voluntarily dismissed Thursday.

The message—“Suck it”—was posted on Noem’s official DHS social media account alongside the court filing confirming the case’s dismissal.

The lawsuit, which targeted Homeland Security officials over a reported plan to transfer 10 detained migrants to the Guantánamo Bay detention facility, was dropped after several plaintiffs were deported and others declined to proceed.

The ACLU originally alleged the Trump administration lacked legal authority to send migrants to the U.S. military prison in Cuba, stating that such transfers would violate federal law and the Constitution.

The ACLU’s complaint included the case of two Venezuelan nationals who had been separated from their 2-year-old daughter.

DHS later stated the child was placed in foster care for her protection, alleging that the parents were affiliated with Tren de Aragua, a Venezuelan drug cartel. The child has since been returned to Caracas.

Noem’s sharp reaction to the case’s dismissal triggered widespread reaction online, splitting opinion largely along political lines.

Supporters praised her directness, with some labeling the response “the best ever,” while critics questioned the tone and professionalism of a Cabinet secretary publicly using such language.

“Coming from the Secretary of the Homeland, what are you getting at?” one user posted in response to the message, pointing out that the comment came from her official DHS account.

The controversy comes amid broader scrutiny of Noem’s leadership style and public persona since assuming the role of Homeland Security Secretary under President Donald Trump.

Critics have accused her of prioritizing media appearances and photo ops over policy execution, citing incidents including a social media post during a live immigration raid and heavily publicized visits to detention centers and international prisons.

Despite criticisms, the Trump administration has maintained that its immigration policies under Noem’s leadership have been effective.

Illegal border crossings are reportedly at their lowest level in decades, and more than 4,000 Venezuelan nationals have been deported since February, including some from Mexico who intended to cross into the United States.

President Trump has also announced plans to use Guantánamo Bay as a detention site for what he termed “the worst criminal aliens” and others who are difficult to deport.

The Cuban facility could hold up to 30,000 illegal immigrants under the new policy, according to administration officials.

“President Donald Trump has been very clear: Guantanamo Bay will hold the worst of the worst. That starts today,” Noem said in an earlier statement referencing the Venezuelan detainees.

This week, Noem and the administration relaunched the Victims of Immigration Crime Engagement (VOICE) office, originally established during Trump’s first term in 2017.

The Biden-Harris administration had dismantled VOICE in 2021 and replaced it with a broader victim support system that included migrants held in U.S. custody.

At the relaunch event held Wednesday at ICE headquarters, Noem appeared alongside so-called “angel families”—those who lost loved ones to crimes committed by illegal immigrants—and affirmed that the Department of Homeland Security is once again prioritizing their needs.

In addition to policy moves, Noem has implemented changes inside DHS, including polygraph testing for employees and encouraging voluntary staff departures aimed at rooting out internal leaks.

Some within the department reportedly view her more as a political figurehead than a policy driver, but Noem’s defenders point to measurable success in enforcement as proof of her effectiveness.

While criticism over her media style continues, Noem remains a high-profile figure in the administration’s aggressive stance on immigration and border security.
