Brevard County Sheriff Wayne Ivey issued a public warning last week directed at individuals who use protests as cover for breaking the law, including blocking traffic, fleeing arrest, or engaging in violent acts against law enforcement.
The message, delivered during a press briefing, was explicit: peaceful protests are allowed under the First Amendment, but unlawful actions will face legal consequences—and, in extreme cases, lethal force.
Despite that clarification, pop artist and rapper Lizzo posted a social media video in which she accused Sheriff Ivey of threatening to kill “anyone who exercises their First Amendment right to protest.”

Her interpretation of the sheriff’s statement, however, omitted key portions where he specifically distinguished between lawful protest and illegal behavior.
Sheriff Ivey had stated, “If you resist lawful orders, you’re going to jail. Let me be very clear about that. If you block an intersection or roadway in Brevard County, you are going to jail. If you flee arrest, you’re gonna go to jail tired because we are gonna run you down and put you in jail.”
He added that any attempt to violently obstruct traffic or target law enforcement would escalate the response.
“If you try to mob rule a car in Brevard County, gathering around it, refusing to let the driver leave, in our county you’re most likely gonna get run over and dragged across the street.”

Sheriff Ivey continued: “If you spit on us, you’re going to the hospital and then jail. If you hit one of us, you’re going to the hospital and then jail and most likely get bitten by one of our big beautiful dogs that we have here.”
The most serious warning came at the end of his remarks: “If you throw a brick, a firebomb, or point a gun at one of our deputies, we will be notifying your family where to collect your remains at. Because we will kill you graveyard dead. We’re not gonna play.”

Lizzo did not reference those qualifications in her response.
“I just watched a video of law enforcement saying they would kill — kill — anyone who exercises their First Amendment rights to protest,” the singer said.
“And I’ve never seen anything more unconstitutional in my life. It was actually appalling.”
She drew historical parallels, referencing Crispus Attucks, a Black man killed during the 1770 Boston Massacre and widely regarded as the first casualty of the American Revolution.
“It is the literal reason why we have our First Amendment right to assemble,” she said.
Lizzo continued by asserting that the U.S. is experiencing a “constitutional crisis,” though she did not provide specifics.
“We don’t serve a king,” she said.
“We don’t serve a dictator. We fought, and lived, and died for the right to vote for people who will protect and serve us, the people — we the people.”
The singer concluded by urging her audience to “remember their constitutional rights” and to “protect each other.”
She added, “Because the people that we put in position to protect us are not doing that. Know your rights, and stand on ’em.”

Sheriff Ivey did not issue an additional statement responding to Lizzo’s remarks, but his original message has remained available publicly, where the distinction between lawful protest and unlawful behavior is made clear.
No examples have emerged showing that Brevard County law enforcement has targeted peaceful or law-abiding protesters, and Lizzo did not cite any such incidents.
Sheriff Ivey’s warning remains focused on the potential legal and physical consequences of engaging in violent or obstructive conduct under the guise of protest.
